AMENDMENT TO HOUSE BILL 1700 




2    AMENDMENT NO. ______. Amend House Bill 1700 by replacing 
3everything after the enacting clause with the following:


 
 
4    "Section 5. The Illinois Municipal Code is amended  by 
5adding Section 11-6-7 as follows:
 
6    (65 ILCS 5/11-6-7 new)
7    Sec. 11-6-7. Annexation; intergovernmental agreement.
8    (a) Whenever an unincorporated parcel of land that is 
9within the boundaries of a fire protection district is annexed 
10into the corporate limits of a municipality with a municipal 
11fire department, the municipal fire department and the fire 
12protection district may negotiate an intergovernmental 
13agreement to allow the fire protection district to have 
14jurisdiction over the annexed parcel in such instances when it 
15is not economically feasible for the municipal fire department 
16to have jurisdiction over the annexed property or when the

1municipal fire department has determined that a hardship exists 
2that would compromise the safety and well-being of the annexed 
3property. If no agreement is adopted by both the municipality 
4and fire protection district, then the automatic transfer of 
5jurisdiction from the fire protection district to the 
6municipality shall occur upon annexation.
7    (b) This Section is repealed 12 months after becoming law, 
8or on June 30, 2012, whichever is first. 
 
 
9    Section 99. Effective date. This Act takes effect upon 
10becoming law.".
