AMENDMENT TO HOUSE BILL 2264




2    AMENDMENT NO. ______. Amend House Bill 2264 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The State Finance Act is amended by adding 
5Section 5.786 as follows:
 
6    (30 ILCS 105/5.786 new)
7    Sec. 5.786. The Illinois Patriot Guard Fund.
 
8    Section 10. The Illinois Vehicle Code is amended  by adding 
9Section 3-696 as follows:
 
10    (625 ILCS 5/3-696 new)
11    Sec. 3-696. Illinois Patriot Guard plates.
12    (a) In addition to any other special license plate, the 
13Secretary, upon
receipt of all applicable fees and applications 
14made in the form prescribed
by the Secretary of State, may

1issue Illinois Patriot Guard license plates to
residents of 
2Illinois who meet eligibility requirements prescribed by the

3Secretary of State.  The special Illinois Patriot Guard plate 
4issued under this
Section shall be affixed only to passenger 
5vehicles of the first division, motorcycles, and motor vehicles 
6of the second division weighing not more than 8,000 pounds.  
7Plates issued under this Section shall expire according to the

8staggered multi-year procedure established by Section 3-414.1 
9of this Code.
10    (b) The plates shall display the Illinois Patriot Guard 
11emblem.  In all other
respects, the design, color, and format of 
12the plates shall be within the
discretion of the Secretary of 
13State.  The Secretary may, in his or her
discretion, allow the 
14plates to be issued as vanity or personalized plates in

15accordance with Section 3-405.1 of this Code.  The plates are 
16not required to
designate "Land of Lincoln", as prescribed in 
17subsection (b) of Section 3-412
of this Code.  The Secretary 
18shall prescribe the eligibility requirements and,
in his or her 
19discretion, shall approve and prescribe stickers or decals as

20provided under Section 3-412.
21    (c) An applicant for the special plate shall be charged a 
22$40 fee for original issuance in addition to the appropriate 
23registration fee. Of this fee, $25 shall be deposited into the 
24Illinois Patriot Guard Fund and $15 shall be deposited into the 
25Secretary of State Special License Plate Fund to be used by the 
26Secretary to help defray the administrative processing costs.

1For each registration renewal period, a $27 fee, in addition to 
2the appropriate registration fee, shall be charged. Of this 
3fee, $25 shall be deposited into the Illinois Patriot Guard 
4Fund and $2 shall be deposited into the Secretary of State 
5Special License Plate Fund.
6    (d) The Illinois Patriot Guard Fund is created as a special 
7fund in the State treasury. All moneys in the Illinois Patriot 
8Guard Fund shall be paid, subject to appropriation by the 
9General Assembly and approval by the Secretary, as grants to 
10the Illinois Illinois Patriot Guard Riders, a not-for-profit 
11corporation, for charitable assistance to  Illinois Patriot 
12Guard Riders and their missions to the people of Illinois. 
 

13    Section 99. Effective date. This Act takes effect upon 
14becoming law.".
