| 1 | | AN ACT concerning transportation.

| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Toll Highway Act is amended by adding |
| 5 | | Section 32.1 as follows:
|
| 6 | | (605 ILCS 10/32.1 new) |
| 7 | | Sec. 32.1. Power to construct railroad tracks. The |
| 8 | | Authority may exercise any powers that exist under this Act on |
| 9 | | the effective date of this amendatory Act of the 97th General |
| 10 | | Assembly to construct new railroad tracks. The Authority may |
| 11 | | charge an access fee to any passenger or freight rail operator |
| 12 | | who wishes to use tracks which the Authority has constructed |
| 13 | | using the powers granted by this Section. Moneys in the Road |
| 14 | | Fund may not be used to implement this Section.

| 15 | | Section 99. Effective date. This Act takes effect upon |
| 16 | | becoming law.
