| 1 | | AN ACT concerning criminal law.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Code of Criminal Procedure of 1963 is |
| 5 | | amended by adding Section 115-23 as follows:
|
| 6 | | (725 ILCS 5/115-23 new) |
| 7 | | Sec. 115-23. Nondisclosure of certain information about |
| 8 | | victims and witnesses. |
| 9 | | (a) During a trial or hearing related to a criminal |
| 10 | | prosecution, the court shall order that the residence address, |
| 11 | | business address, name
of the place of business, home telephone |
| 12 | | number, or business telephone
number of any victims of or |
| 13 | | witnesses to the crime shall not be
disclosed in open court. |
| 14 | | (b) During questioning by the State or defense, a victim or |
| 15 | | witness shall not be
required to disclose the information |
| 16 | | listed in subsection (a) unless the court determines that there |
| 17 | | is a compelling reason to order such disclosure in the interest |
| 18 | | of justice that outweighs prejudice to the victim or witness.
