| 2 | | AMENDMENT NO. ______. Amend House Bill 3816, AS AMENDED, by |
| 3 | | replacing everything after the enacting clause with the |
| 4 | | following:
|
| 5 | | "Section 5. The Gubernatorial Boards and Commissions Act is |
| 6 | | amended by adding Section 25 as follows: |
| 7 | | (15 ILCS 50/25 new) |
| 8 | | Sec. 25. Dissolution of inactive boards and commissions. |
| 9 | | (a) Within 30 days after the effective date of this |
| 10 | | amendatory Act of the 97th General Assembly, each statutorily |
| 11 | | created board or commission not subject to subsection (g) shall |
| 12 | | report to the Secretary of State on that board's or |
| 13 | | commission's last meeting prior to the effective date of this |
| 14 | | amendatory Act of the 97th General Assembly, and the report |
| 15 | | shall include the date, time, and location of the meeting. |
| 16 | | (b) Within 60 days after the effective date of this |

| 1 | | amendatory Act of the 97th General Assembly, the Secretary of |
| 2 | | State shall submit a report to the Governor, the Secretary of |
| 3 | | the Senate, and the Clerk of the House of Representatives, |
| 4 | | listing all statutorily created boards and commissions that |
| 5 | | have not met in the 2 years immediately preceding the effective |
| 6 | | date of this amendatory Act of the 97th General Assembly. If a |
| 7 | | board or commission not subject to subsection (g) does not |
| 8 | | report to the Secretary of State pursuant to this subsection, |
| 9 | | then it shall be deemed to be inactive and subject to the |
| 10 | | provisions of subsections (d) and (e). |
| 11 | | (c) Within 14 days after the 30-day period set forth in |
| 12 | | subsection (a), the Secretary of State shall provide, to each |
| 13 | | board or commission that has not met in the 2 years immediately |
| 14 | | preceding the effective date of this amendatory Act of the 97th |
| 15 | | General Assembly or that does not report to the Secretary of |
| 16 | | State in accordance with subsection (a), written notice of the |
| 17 | | board's or commission's right to request that the Governor |
| 18 | | prevent the dissolution of the board or commission by filing a |
| 19 | | written statement in accordance with subsection (e). |
| 20 | | (d) Unless the Governor acts pursuant to subsection (e), if |
| 21 | | a board or commission has not met at least once during the 2 |
| 22 | | years prior to the effective date of this amendatory Act of the |
| 23 | | 97th General Assembly and is reported as inactive pursuant to |
| 24 | | subsection (a), then the board or commission is dissolved at |
| 25 | | the end of the 60-day period set forth in subsection (e). |
| 26 | | (e) Within 75 days after the Governor's receipt of the |

| 1 | | report submitted by the Secretary of State under subsection |
| 2 | | (b), the Governor may prevent the dissolution of any inactive |
| 3 | | board or commission by filing a written statement with the |
| 4 | | Secretary of State and the Senate that authorizes the continued |
| 5 | | existence of the board or commission and provides a rationale |
| 6 | | for why the board or commission needs to exist. |
| 7 | | (f) Within 14 days after the 60-day period set forth in |
| 8 | | subsection (e), the Governor shall publish a list of all boards |
| 9 | | and commissions dissolved under subsection (d). The |
| 10 | | Legislative Reference Bureau shall prepare for introduction no |
| 11 | | later than in the annual session of the General Assembly next |
| 12 | | occurring after the list is published by the Governor a |
| 13 | | revisory bill effecting such changes in the statutes as may be |
| 14 | | necessary to conform the statutes to the changes in law made by |
| 15 | | the dissolution of the boards and commissions included in the |
| 16 | | list published by the Governor. The failure of the General |
| 17 | | Assembly to enact such a bill does not affect the validity of |
| 18 | | the dissolution of any board or commission under this Section. |
| 19 | | (g) Any board or commission created after July 1, 2010 is |
| 20 | | exempt from this Section.

| 21 | | Section 99. Effective date. This Act takes effect upon |
| 22 | | becoming law.".
