| 1 | | AMENDMENT TO HOUSE BILL 3969

| 2 | | AMENDMENT NO. ______. Amend House Bill 3969 on page 1, in |
| 3 | | line 19, after "by", by inserting "the employer of the |
| 4 | | participant under"; and

| 5 | | on page 2, below line 15, by inserting the following: |
| 6 | | "(c) If an employer fails to pay the amount required under |
| 7 | | this Section to the General Assembly Retirement System for more |
| 8 | | than
90 days after the payment is due, the System, after
giving |
| 9 | | notice to the employer, may certify to
the State Comptroller |
| 10 | | the amount of the delinquent payment and the
Comptroller shall |
| 11 | | deduct the amount so certified or any part thereof
from any |
| 12 | | payment of State funds to the employer and shall pay the amount |
| 13 | | so deducted to the System. If State
funds from which such |
| 14 | | deductions may be made are not available, then the System
may |
| 15 | | proceed against the employer to recover the
amount of the |
| 16 | | delinquent payment in the appropriate circuit court.".
