| 1 | | AN ACT concerning transportation.

| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Toll Highway Act is amended by adding |
| 5 | | Section 32.1 as follows:
|
| 6 | | (605 ILCS 10/32.1 new) |
| 7 | | Sec. 32.1. Power to construct railroad tracks. Upon written |
| 8 | | approval by the Governor, the Authority may exercise any powers |
| 9 | | that exist under this Act on the effective date of this |
| 10 | | amendatory Act of the 97th General Assembly to design and |
| 11 | | construct new railroad tracks. The Authority may charge an |
| 12 | | access fee to any passenger or freight rail operator who wishes |
| 13 | | to use tracks which the Authority has constructed using the |
| 14 | | powers granted by this Section. Moneys in the Road Fund may not |
| 15 | | be used to implement this Section. Authorization must be |
| 16 | | granted to the Authority for each individual and distinct |
| 17 | | railroad track project.

| 18 | | Section 99. Effective date. This Act takes effect upon |
| 19 | | becoming law.
