| 4 | | "Section 5. The Illinois Sexually Transmissible Disease |
| 5 | | Control Act is amended by changing Section 9 as follows:

| 7 | | Sec. 9. Prisoners. |
| 8 | | (a) The Department and its authorized
representatives may, |
| 9 | | at its discretion, enter any State, county or
municipal |
| 10 | | detention facility to interview, examine and treat any prisoner
|
| 11 | | for a sexually transmissible disease. Any such State, county or |
| 12 | | municipal
detention facility shall cooperate with
the |
| 13 | | Department and its authorized representative to provide such |
| 14 | | space as
is necessary for the examination and treatment of all |
| 15 | | prisoners suffering
from or suspected of having a sexually |
| 16 | | transmissible disease.

| 1 | | (b) Nothing in this Section shall be construed as relieving |
| 2 | | the
Department of Corrections or any county or municipality of |
| 3 | | their primary
responsibility for providing medical treatment |
| 4 | | for prisoners under their
jurisdiction, including treatment |
| 5 | | for sexually transmissible diseases.
|
| 6 | | (c) Any person who knowingly or maliciously disseminates |
| 7 | | any false
information or report concerning the existence of any |
| 8 | | sexually
transmissible disease under this Section is guilty of |
| 9 | | a Class A misdemeanor.
|
| 10 | | (d) The Department, in consultation with the Department of |
| 11 | | Corrections, shall develop and implement written procedures |
| 12 | | that establish a process for confidentially notifying and |
| 13 | | recommending sexually transmissible disease testing of the |
| 14 | | contacts of a committed person who has been diagnosed with a |
| 15 | | sexually transmissible disease and for notifying and |
| 16 | | recommending sexually transmissible disease testing of a |
| 17 | | committed person who has had contact with one diagnosed with a |
| 18 | | sexually transmissible disease. The process shall be in |
| 19 | | accordance with Sections 3, 5, and 8 of this Act. |

| 21 | | Section 99. Effective date. This Act takes effect upon |
| 22 | | becoming law.".
