| 4 | | "Section 5. The Illinois Plumbing License Law is amended by |
| 5 | | changing Section 35 as follows:

| 6 | | (225 ILCS 320/35) (from Ch. 111, par. 1133)

| 7 | | Sec. 35.
The Department shall promulgate and publish and |
| 8 | | may from time
to time amend a minimum code of standards for |
| 9 | | plumbing and the fixtures,
materials, design and installation |
| 10 | | methods of plumbing systems based upon
the findings of the |
| 11 | | sciences of pneumatics and hydraulics, after consideration
of |
| 12 | | the recommendations of the Plumbing Code Advisory Council.
By |
| 13 | | January 1, 2013, the Plumbing Code Advisory Council shall |
| 14 | | recommend amendments to the existing minimum code of standards |
| 15 | | for plumbing and the fixtures, materials, design, and |
| 16 | | installation methods of plumbing systems to reflect advances in |
|

| 1 | | those technologies and methods that more efficiently utilize |
| 2 | | natural resources and protect public health. Upon |
| 3 | | consideration of those recommendations, the Department shall |
| 4 | | submit the amendments to the existing minimum code of standards |
| 5 | | to the Joint Committee on Administrative Rules by May 31, 2013. |
| 6 | | The Department may promulgate and publish rules in the State's |
| 7 | | minimum
code of standards for the minimum number of plumbing |
| 8 | | fixtures required for
the comfort and convenience of workers |
| 9 | | and the public not inconsistent
with, but not limited to, the |
| 10 | | requirements of the federal Americans With
Disabilities Act, |
| 11 | | the Equitable Restrooms Act, and the U.S. Department
of Labor, |
| 12 | | Office of Safety and Health Administration. The minimum
code of |
| 13 | | standards for plumbing and any amendments thereto shall be |
| 14 | | filed
with the Secretary of State as a public record. In |
| 15 | | preparing plumbing code
standards and amendments thereto the |
| 16 | | Department may give consideration to
the recommendations |
| 17 | | contained in nationally recognized plumbing codes and
|
| 18 | | recommendations of nationally recognized material and |
| 19 | | equipment testing
laboratories. The plumbing code promulgated |
| 20 | | by the Department under
authority of this Act shall remain in |
| 21 | | effect as the minimum
code authorized by this Act until the |
| 22 | | Department promulgates a new code
under authority of this Act. |
| 23 | | At least 20 days' notice of a public hearing
shall be given by |
| 24 | | the Department in a manner which the Department considers
|
| 25 | | adequate to bring the hearing to the attention of persons |
| 26 | | interested in
plumbing code standards. Notice of any public |
