| 2 | | AMENDMENT NO. ______. Amend House Bill 4569 as follows:

| 3 | | on page 1, line 5, by replacing "Sections 6a, 8a, 8c, 9, and |
| 4 | | 10b.16" with "Sections 5c, 8a, and 8c"; and
|
| 5 | | on page 1, immediately below line 6, by inserting the |
| 6 | | following:
|
| 7 | | "(15 ILCS 310/5c) (from Ch. 124, par. 105c)
|
| 8 | | Sec. 5c. Partial exemptions. The following positions in the |
| 9 | | Office of
the Secretary of State are exempt from jurisdictions |
| 10 | | A, B and C to the extent
stated for each unless these |
| 11 | | jurisdictions are extended as provided in this Act:
|
| 12 | | (1) Special agents selected by the Inspector General |
| 13 | | appointed pursuant to Section 14 of the Secretary of State Act |
| 14 | | and licensed Licensed attorneys in positions as legal or |
| 15 | | technical advisors, except
in those positions paid from federal |
|

| 1 | | funds if such exemption is inconsistent
with federal |
| 2 | | requirements, are exempt from jurisdiction B only to the extent
|
| 3 | | that Sections 10b.1, 10b.3 and 10b.5 of this Code need not be |
| 4 | | met.
|
| 5 | | (2) All unskilled positions, unless such exemption is |
| 6 | | inconsistent with
federal requirements in those positions paid |
| 7 | | from federal funds, for which
the principal job requirement is |
| 8 | | good physical condition are exempt from jurisdiction B.
|
| 9 | | (3) The Merit Commission, upon written recommendation of |
| 10 | | the Director,
shall exempt from jurisdiction B other positions |
| 11 | | which, in the judgment
of the Commission, are by their nature |
| 12 | | highly confidential or involve principal
administrative |
| 13 | | responsibility for the determination of policy or principal
|
| 14 | | administrative responsibility for the way in which policies are |
| 15 | | carried
out, except in those positions paid from federal funds |
| 16 | | if such exemption
is inconsistent with federal requirements. No |
| 17 | | position which has the powers
of a law enforcement officer, |
| 18 | | except executive security officers, may be
exempted under this |
| 19 | | section.
|
| 20 | | (4) The personal secretaries and chief deputy to persons |
| 21 | | exempted under
paragraph (3) of Section 5b of this Act are |
| 22 | | exempt from jurisdiction B,
unless such exemption is |
| 23 | | inconsistent with federal requirements in those
positions paid |
| 24 | | from federal funds.

| 25 | | (5) Positions which are paid a prevailing rate of wage are |
| 26 | | exempt from jurisdiction B.
