Amends the Collection Agency Act. Provides that each collection agency shall develop and maintain a written internal policy regarding the prevention of debtor incarceration. Effective January 1, 2013.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Collection Agency Act is amended by adding |
| 5 | | Section 9.6 as follows:
|
| 6 | | (225 ILCS 425/9.6 new) |
| 7 | | Sec. 9.6. Debtor incarceration prevention. Each collection |
| 8 | | agency shall develop and maintain a written internal policy |
| 9 | | regarding the prevention of debtor incarceration. Provisions |
| 10 | | that shall be included in the policy include, but are not |
| 11 | | limited to, provisions regarding instructions to be given to |
| 12 | | legal counsel handling collection cases on behalf of the |
| 13 | | collection agency.

| 14 | | Section 99. Effective date. This Act takes effect January |
| 15 | | 1, 2013.
