| 1 | | AN ACT concerning regulation.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Nursing Home Care Act is amended by changing |
| 5 | | Section 3-502 as follows:
|
| 6 | | (210 ILCS 45/3-502) (from Ch. 111 1/2, par. 4153-502)
|
| 7 | | Sec. 3-502.
When a monitor is placed in a facility in In |
| 8 | | any situation described in Section 3-501, the Department
may |
| 9 | | place a qualified person to act as monitor in the facility. The |
| 10 | | monitor
shall observe operation of the facility, shall assist |
| 11 | | the facility by advising
it on how to comply with the State |
| 12 | | regulations, and shall report periodically
to the Department on |
| 13 | | the operation of the facility. Reports from the monitor shall |
| 14 | | be submitted to the Department on the first day of each month. |
| 15 | | Upon written request by the facility, the Department shall |
| 16 | | provide the facility with a redacted copy of the report, |
| 17 | | subject to the confidentiality restrictions as stated in |
| 18 | | Section 2-206 of this Act and with the name, room number, or |
| 19 | | any other characteristic that may enable the specific person to |
| 20 | | be identified who has given information to the monitor deleted. |
| 21 | | Monitor reports shall not be subject to the Freedom of |
| 22 | | Information Act, as provided in that Act. A facility may submit |
| 23 | | to the Department and the monitor a statement refuting any of |
