| 4 | | "Section 5. The Intergovernmental Cooperation Act is |
| 5 | | amended by changing Section 2 as follows:
|
| 6 | | (5 ILCS 220/2) (from Ch. 127, par. 742)

| 7 | | Sec. 2. Definitions. For the purpose of this Act:
|
| 8 | | (1) The term "public agency" shall mean any unit of local |
| 9 | | government as
defined in the Illinois Constitution of 1970, any |
| 10 | | school district, any public
community college district, any |
| 11 | | public building commission, the
State of Illinois, any agency |
| 12 | | of the State government or of the United
States, or of any |
| 13 | | other State, any political subdivision of another
State, and |
| 14 | | any combination of the above pursuant to an intergovernmental
|
| 15 | | agreement which includes provisions for a governing body of the |
| 16 | | agency created
by the agreement.

| 1 | | For the purposes of this Act, "public agency" includes: |
| 2 | | (A) the Mid-America
Intermodal Authority Port District |
| 3 | | created under the Mid-America Intermodal
Authority Port |
| 4 | | District Act; and |
| 5 | | (B) the Illinois Law Enforcement Alarm System.

| 6 | | (2) The term "state" shall mean a state of the United |
| 7 | | States.
|

| 9 | | Section 10. The Illinois Vehicle Code is amended by adding |
| 10 | | Section 7-601.5 as follows:
|
| 11 | | (625 ILCS 5/7-601.5 new) |
| 12 | | Sec. 7-601.5. Illinois Law Enforcement Alarm Systems |
| 13 | | insurance surcharge. |
| 14 | | (a) Every insurance company or surety company authorized to |
| 15 | | do business in this State shall collect an annual surcharge of |
| 16 | | $1 for each vehicle covered by a liability insurance policy |
| 17 | | issued in accordance with Section 7-601 of this Code.
The |
| 18 | | surcharge shall be collected at the same time and in the same |
| 19 | | manner that the premium or other charge for the insurance |
| 20 | | coverage is collected. |
| 21 | | (b) Each month, the insurer shall remit all surcharge |
| 22 | | moneys collected to the Treasurer for deposit into the Illinois |
| 23 | | Law Enforcement Alarm Systems Fund. |
| 24 | | (c) Moneys deposited into the Illinois Law Enforcement |

| 1 | | Alarm Systems Fund under this Section shall be allocated, |
| 2 | | subject to the approval of the Illinois Law Enforcement Alarm |
| 3 | | System (ILEAS) Governing Board, as follows: (i) 72% shall be |
| 4 | | used for homeland security initiatives established by the ILEAS |
| 5 | | Governing Board; (ii) 25% shall be used for airborne |
| 6 | | operations; and (iii) 3% shall be retained by the Illinois |
| 7 | | Emergency Management Agency to be used to administer the Fund. |
| 8 | | (d) The Illinois Emergency Management Agency shall |
| 9 | | establish guidelines for the expenditure of surcharges |
| 10 | | collected under this Section. Under the guidelines, the |
| 11 | | expenditure of the surcharges shall enhance local law |
| 12 | | enforcement homeland security and local law enforcement mutual |
| 13 | | aid activities in this State and support public safety airborne |
| 14 | | operations. The ILEAS Governing Board shall annually supply the |
| 15 | | Director of the Illinois Emergency Management Agency with a |
| 16 | | report of the use of surcharges collected under this Section. |
| 17 | | (e) This Section does not apply to vehicles owned by (i) |
| 18 | | units of local, State, or federal government and (ii) |
| 19 | | organizations based in this State that meet the requirements of |
| 20 | | Title 26, Section 501(c)(3) of the United States Code.".
