Amends the Fire Sprinkler Contractor Licensing Act. Provides that a municipality, county, or township may not mandate that a fire sprinkler systems is installed in any newly constructed single-family residence. Provides that a municipality, county, or township shall mandate that a residential home builder must offer to each of the residential home builder's clients the option to install a fire sprinkler system in the newly constructed single-family residence. Pre-empts home rule.

| 2 | | Be it enacted by the People of the State of Illinois,

| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Fire Sprinkler Contractor Licensing Act is |
| 5 | | amended by adding Section 48 as follows:
|

| 7 | | Sec. 48. Fire sprinkler installation; residential homes. A |
| 8 | | municipality, county, or township may not mandate that a fire |
| 9 | | sprinkler systems is installed in any newly constructed |
| 10 | | single-family residence. |
| 11 | | A municipality, county, or township shall mandate that a |
| 12 | | residential home builder must offer to each of the residential |
| 13 | | home builder's clients the option to install a fire sprinkler |
| 14 | | system in the newly constructed single-family residence. |
| 15 | | A home rule unit may not regulate the installation of fire |
| 16 | | sprinkler systems in a newly constructed single-family |
| 17 | | residence in a manner inconsistent with this Section. This |
| 18 | | Section is a limitation under subsection (i) of Section 6 of |
| 19 | | Article VII of the Illinois Constitution on the concurrent |
| 20 | | exercise by home rule units of powers and functions exercised |
| 21 | | by the State.
