AMENDMENT TO SENATE BILL 50 




2    AMENDMENT NO. ______. Amend Senate Bill 50, AS AMENDED, 
3with reference to page and line numbers of House Amendment No. 
41 as follows:


 
5on page 23, immediately below line 12, by inserting the 
6following:
 
7    "(cc)  Notwithstanding any provision of this Section to the 
8contrary, nothing in this Section shall prohibit the issuance 
9or renewal of a license authorizing the sale of alcoholic 
10liquor at a premises that is located within a municipality with 
11a population in excess of 1,000,000 inhabitants and within 100 
12feet of a school if:
13        (1) the sale of alcoholic liquor is not the principal 
14    business carried on by the licensee at the premises;
15        (2) the licensee shall only sell packaged liquors at 
16    the premises;

1        (3) the licensee is a national retail chain;
2        (4) as of October 25, 2011, the licensee has 1,767 
3    stores operating nationwide, 87 stores operating in the 
4    State, and 10 stores operating within the municipality;
5        (5) the licensee shall occupy approximately 124,000 
6    square feet of space in the basement and first and second 
7    floors of a building located across the street from a 
8    school;
9        (6) the school opened in August of 2009 and occupies 
10    approximately 67,000 square feet of space; and
11        (7) the building in which the premises shall be located 
12    has been listed on the National Register of Historic Places 
13    since April 17, 1970.".
