1    AN ACT concerning transportation.

 
2    Be it enacted by the People of the State of Illinois, 
3represented in the General Assembly: 



 
4    Section 5. The Fox Waterway Agency Act is amended  by 
5changing Section 3 and  by adding Section 3.1 as follows:
 



6    (615 ILCS 90/3)  (from Ch. 19, par. 1203)



7    Sec. 3. As used in this Act, unless the context otherwise 
8requires: 

9    (a) "Agency" means the  Fox Waterway Agency
created by this 
10Act.

11    (b) "Board" means the board of directors of the Fox 
12Waterway Agency.

13    (c) "Director" means a member of the board of directors of 
14the  Fox Waterway Agency.

15    (d) "Member County" means that portion of either Lake 
16County or McHenry
County which lies within the territory of the 
17Agency.

18    (e) "Chain of Lakes Fox River Recreational Waterway" or 
19"waterway" "Waterway" means the Fox River and interconnecting 
20lakes commonly
known as the Chain O Lakes from the Wisconsin 
21State line to the Algonquin
Dam, all within the State of 
22Illinois, and includes all streams, bayous, sloughs, 
23backwaters, side channels, improved channels, and submerged

1lands or parts thereof which lie within the territory of the 
2Agency.

5    Sec. 3.1. Public use. All waters within the waterway are 
6open to the public for navigation and fishing.
 

7    Section 99. Effective date. This Act takes effect upon 
8becoming law.
