| 1 | | scratch-off lottery tickets established under Section 21.9 of |
| 2 | | this Act; (iii) be required to purchase those instant |
| 3 | | scratch-off lottery tickets at face value from the Illinois |
| 4 | | Lottery; and (iv) only sell those tickets at face value. |
| 5 | | Specialty retailer licensees may obtain a refund from the |
| 6 | | Division for any unsold instant scratch-off lottery tickets |
| 7 | | that they have purchased for resale, as set forth in the |
| 8 | | specialty retailer agreement. |
| 9 | | (b) A specialty retailer licensee shall receive a sales |
| 10 | | commission equal to 2% of the face value of specialty game |
| 11 | | tickets purchased from the Department, less adjustments for |
| 12 | | unsold tickets returned to the Illinois Lottery for credit. A |
| 13 | | specialty retailer licensee may not cash winning tickets, but |
| 14 | | are entitled to a 1% bonus in connection with the sale of a |
| 15 | | winning specialty game ticket having a price value of $1,000 or |
| 16 | | more. |

| 18 | | Sec. 21.9. Scratch-off for Seniors. |
| 19 | | (a) The Department shall offer a special instant |
| 20 | | scratch-off game for the benefit of Illinois seniors with the |
| 21 | | title of "Scratch-off for Seniors". The game shall commence on |
| 22 | | July 1, 2011 or as soon thereafter, at the discretion of the |
| 23 | | Director, as is reasonably practical. The operation of the game |
| 24 | | shall be governed by this Act and any rules adopted by the |
| 25 | | Department. The Department must consult with the Community |

| 1 | | Senior Services and Resource Center Advisory Committee, which |
| 2 | | is established under Section 35 of the Community Senior |
| 3 | | Services and Resources Act, regarding the design and the |
| 4 | | promotion of the game. If any provision of this Section is |
| 5 | | inconsistent with any other provision of this Act, then this |
| 6 | | Section governs. |
| 7 | | (b) The net revenue from the Scratch-Off for Seniors game |
| 8 | | shall be deposited into the Community Senior Services and |
| 9 | | Resources Fund for appropriation by the General Assembly to the |
| 10 | | Department of Aging for the purpose of making grants to |
| 11 | | community senior services and resource centers as established |
| 12 | | under the Community Senior Services and Resources Act. |
| 13 | | Moneys collected from the Scratch-Off for Seniors game |
| 14 | | shall be used only as supplemental financial resources and |
| 15 | | shall not supplant existing moneys that the Department on Aging |
| 16 | | may currently expend on community senior services and resource |
| 17 | | centers. |
| 18 | | Moneys received for the purposes of this Section, |
| 19 | | including, without limitation, net revenue from the |
| 20 | | Scratch-Off for Seniors game and from gifts, grants, and awards |
| 21 | | from any public or private entity, must be deposited into the |
| 22 | | Fund. Any interest earned on moneys in the Fund must be |
| 23 | | deposited into the Fund. |
| 24 | | For purposes of this subsection (b), "net revenue" means |
| 25 | | the total amount for which tickets have been sold less the sum |
| 26 | | of the amount paid out in prizes and the actual administrative |

| 1 | | expenses of the Department solely related to the Scratch-Off |
| 2 | | for Seniors game under this Section. |
| 3 | | (c) The Department shall not unreasonably diminish the |
| 4 | | efforts devoted to marketing any other instant scratch-off |
| 5 | | lottery game as a result of selling tickets for the Scratch-Off |
| 6 | | for Seniors game. |
| 7 | | (d) The Department may adopt any rules necessary to |
| 8 | | implement and administer the provisions of this Section.

| 9 | | Section 99. Effective date. This Act takes effect upon |
| 10 | | becoming law.".
