AMENDMENT TO SENATE BILL 623




2    AMENDMENT NO. ______. Amend Senate Bill 623 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The School Code is amended  by adding Section 
52-3.25g-5 as follows:
 
6    (105 ILCS 5/2-3.25g-5 new)
7    Sec. 2-3.25g-5. Waivers with respect to Fiscal Year 2012. 
8For Fiscal Year 2012, a school district (1) may choose to waive 
9any mandate placed on it by this Code or the State Board of 
10Education's administrative rules, with the exception of laws 
11and rules pertaining to special education, teacher 
12certification, teacher tenure, and seniority; Section 5-2.1 of 
13this Code; and compliance with the federal No Child Left Behind 
14Act of 2001 (Public Law 107-110); or (2) on and after the 
15applicable implementation date, may not seek a waiver or seek a 
16modification of a mandate regarding the requirements for (A)

1student performance data to be a significant factor in teacher 
2or principal evaluations or (B) teachers and principals to be 
3rated using the 4 categories of "excellent", "proficient", 
4"needs improvement", or "unsatisfactory". 

 
5    Section 99. Effective date. This Act takes effect July 1, 
62011.".
