AMENDMENT TO SENATE BILL 839




2    AMENDMENT NO. ______. Amend Senate Bill 839 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Mental Health and Developmental 
5Disabilities Code is amended  by adding Section 2-101.1 as 
6follows:
 
7    (405 ILCS 5/2-101.1 new)
8    Sec. 2-101.1. Outpatient services; consent; costs. 
9    (a) Any adult may request and receive counseling services 
10or psychotherapy on an outpatient basis. If the adult is under 
11guardianship, the consent of the guardian shall not be 
12necessary to authorize outpatient counseling or psychotherapy. 
13The adult's guardian shall not be informed of such counseling 
14or psychotherapy without the consent of the adult unless the 
15facility director believes such disclosure is necessary. If the 
16facility director intends to disclose the fact of counseling or

1psychotherapy, the adult shall be so informed. However, until 
2the consent of the adult's guardian has been obtained, 
3outpatient counseling or psychotherapy provided to an adult 
4under guardianship shall be limited to not more than 5 
5sessions, a session lasting not more than 45 minutes. 
6    (b) The adult's guardian shall not be liable for the costs 
7of outpatient counseling or psychotherapy which is received by 
8the adult without the consent of the adult's guardian.".
