AMENDMENT TO SENATE BILL 1234

2    AMENDMENT NO. ______. Amend Senate Bill 1234 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Mental Health and Developmental
5Disabilities Confidentiality Act is amended by adding Section
69.4 as follows:
 
7    (740 ILCS 110/9.4 new)
8    Sec. 9.4. Disclosure for treatment and coordination of
9care. For purposes of treatment and coordination of care, State
10agencies, including the Department of Corrections, county
11jails, insurance companies, and integrated health systems, may
12disclose records of a recipient without the recipient's consent
13if the recipient is in a program administered or operated by
14the Department of Healthcare and Family Services or the
15Department of Human Services to hospitals, physicians,
16therapists, emergency medical personnel, and members of an

1interdisciplinary team treating a recipient with or without the
2recipient's consent. Providers on an interdisciplinary care
3team treating a recipient may disclose the recipient's records
4without the recipient's consent to other members of the team.
5The records that may be disclosed under this Section are
6services rendered, providers rendering the services,
7pharmaceuticals prescribed or dispensed, and diagnoses. All
8disclosures under this Section must be made in a manner
9consistent with the federal Health Insurance Portability and
10Accountability Act (HIPAA).
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.".
