AMENDMENT TO SENATE BILL 1743




2    AMENDMENT NO. ______. Amend Senate Bill 1743 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The School Code is amended  by adding Section 
52-3.25g-5 as follows:
 
6    (105 ILCS 5/2-3.25g-5 new)
7    Sec. 2-3.25g-5. Waivers with respect to certain districts. 
8A school district that receives less than 15% of its total 
9revenue from this State (1) may choose to waive any mandate 
10placed on it by this Code or the State Board of Education's 
11administrative rules, with the exception of laws and rules 
12pertaining to special education, teacher certification, 
13teacher tenure, and seniority; Section 5-2.1 of this Code; and 
14compliance with the federal No Child Left Behind Act of 2001 
15(Public Law 107-110); or (2) on and after the applicable 
16implementation date, may not seek a waiver or seek a

1modification of a mandate regarding the requirements for (A) 
2student performance data to be a significant factor in teacher 
3or principal evaluations or (B) teachers and principals to be 
4rated using the 4 categories of "excellent", "proficient", 
5"needs improvement", or "unsatisfactory". 

 
6    Section 99. Effective date. This Act takes effect July 1, 
72011.".
