AMENDMENT TO SENATE BILL 1821 




2    AMENDMENT NO. ______. Amend Senate Bill 1821, AS AMENDED, 
3with reference to page and line numbers of House Amendment No. 
41 as follows:


 
5on page 7, by replacing lines 6 through 17 with the following:
6    "(f) The Commission shall make its determination on any 
7application for a certificate of authority filed pursuant to 
8this Section and issue its final order within 11 months after 
9the date that the application is filed. The Commission's 
10failure to act within this time period shall not be deemed an 
11approval or denial of the application.
12    (g) A final order of the Commission granting a certificate 
13of authority pursuant to this Act shall be conditioned upon the 
14applicant obtaining all required permits or approvals from the 
15Pipeline and Hazardous Materials Safety Administration of the 
16U.S. Department of Transportation, U.S. Army Corps of 
17Engineers, and Illinois Department of Agriculture, in addition

1to all other permits and approvals necessary for the 
2construction and operation of the pipeline prior to the start 
3of any construction.  The final order must specifically prohibit 
4the start of any construction until all such permits and 
5approvals have been obtained.".
