| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Public Utilities Act is amended by changing |
| 5 | | Section 21-101.1 as follows:
|

| 7 | | (Section scheduled to be repealed on October 1, 2013) |
| 8 | | Sec. 21-101.1. Applicability. The The provisions of Public |
| 9 | | Act 95-9
shall apply only to a holder of a cable service or |
| 10 | | video service authorization issued by the Commission pursuant |
| 11 | | to this Article, and shall not apply to any person or entity |
| 12 | | that provides cable television services under a cable |
| 13 | | television franchise issued by any municipality or county |
| 14 | | pursuant to Section 11-42-11 of the Illinois Municipal Code (65 |
| 15 | | ILCS 5/11-42-11) or Section 5-1095 of the Counties Code (55 |
| 16 | | ILCS 5/5-1095), unless specifically provided for herein. A |
| 17 | | local unit of government that has an existing agreement for the |
| 18 | | provision of video services with a company or entity that uses |
| 19 | | its telecommunications facilities to provide video service as |
| 20 | | of May 30, 2007 may continue to operate under that agreement or |
| 21 | | may, at its discretion, terminate the existing agreement and |
| 22 | | require the video provider to obtain a State-issued |
| 23 | | authorization under this Article.
