| 1 | | AN ACT concerning criminal law, which may be referred to as |
| 2 | | Caylee's law.
|
| 3 | | Be it enacted by the People of the State of Illinois,
|
| 4 | | represented in the General Assembly:
|
| 5 | | Section 5. The Criminal Code of 1961 is amended by adding |
| 6 | | Section 12-21.6-1 as follows: |
| 7 | | (720 ILCS 5/12-21.6-1 new) |
| 8 | | Sec. 12-21.6-1. Failure to report disappearance of a |
| 9 | | child; failure to report death of a child. |
| 10 | | (a) A parent, legal guardian, or other person having |
| 11 | | physical custody or control of a child, who is 13 years of age |
| 12 | | or younger, commits failure to report the disappearance of a |
| 13 | | child when he or she fails to notify the appropriate law |
| 14 | | enforcement agency in a timely manner, no later than 24 hours, |
| 15 | | of the child's disappearance; and |
| 16 | | (1) knows that the child is missing; or |
| 17 | | (2) reasonably should know that the child is missing. |
| 18 | | (a-5) Sentence.
Failure to report the disappearance of a |
| 19 | | child is a Class 4 felony. |
| 20 | | (b) A parent, legal guardian, or other person having |
| 21 | | physical custody or control of a child, 17 years of age or |
| 22 | | younger, commits failure to report the death of a child when he |
| 23 | | or she discovers the death of a child and knows or reasonably |
