AMENDMENT TO SENATE BILL 2551




2    AMENDMENT NO. ______. Amend Senate Bill 2551 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Prevailing Wage Act is amended  by adding 
5Section 2.5 as follows:
 
6    (820 ILCS 130/2.5 new)
7    Sec. 2.5. Applicability of Act. 
8    (a)     Beginning July 1, 2013, a person engaging or proposing 
9to engage in the construction of a fixed work may submit to the 
10Department a request  for a determination whether the 
11construction is subject to the requirements of this Act.    The 
12request must disclose such information about the construction 
13or proposed construction that the Department may require by 
14rule.
15    (b)    The Department shall issue its determination no later 
16than 90 days after receiving all information necessary to

1render a determination. The Department's decision must state 
2whether the construction or proposed construction is subject to 
3this Act. A determination by the Department that the 
4construction or proposed construction is not subject to this 
5Act  is binding upon the Department, and the Department may not 
6at a later date change the determination.
7    (c)  The Department shall create a record of all requests 
8for a determination under this Section and make the record 
9available to the public on the Department's website. The record 
10shall disclose the relevant facts and the final determination, 
11but must redact all information that may identify the party 
12making the request.
13    (d)  The Department may adopt rules necessary for the 
14implementation of this Section.".
