AMENDMENT TO SENATE BILL 3296 




2    AMENDMENT NO. ______. Amend Senate Bill 3296, AS AMENDED, 
3by replacing everything after the enacting clause with the 
4following:

 
5    "Section 5. The Illinois Procurement Code is amended  by 
6adding Section 40-60 as follows:
 
7    (30 ILCS 500/40-60 new)
8    Sec. 40-60. Third party management. Parties interested in 
9(i) proposing a lease of real property to the State of Illinois 
10or proposing a lease to own contract with a scheduled transfer 
11of ownership of real property to the State of Illinois, and 
12(ii) proposing that the cost of a third party management 
13contract will be paid by the State in addition to the lease 
14rent or lease to own payment shall, at the time of proposal to 
15the State, submit the following information:
16        (1) an identification of any third party manager whom

1    the lessor or owner intends to rely upon or engage as an 
2    agent for purposes of representing the lessor's or owner's 
3    interests to the State;
4        (2) identification of individuals with any (i) 
5    ownership interest in common with the identified third 
6    party manager or independent ownership interest as both 
7    lessor or owner in the subject real property,  and (ii) 
8    ownership interest in the identified third party manager;
9        (3) a list of all services or representations that the 
10    third party manager will provide on behalf of the lessor or 
11    owner  to the State of Illinois; and
12        (4) an itemized cost schedule for management services 
13    and fees for representation to be paid by the State and to 
14    be included in the contract with the  State.
 

15    Section 99. Effective date. This Act takes effect January 
161, 2013.".
