1 | AMENDMENT TO SENATE BILL 3498

2 | AMENDMENT NO. ______. Amend Senate Bill 3498 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Illinois Grant Funds Recovery Act is | ||||||
5 | amended by changing Section 4.2 as follows: | ||||||
6 | (30 ILCS 705/4.2) | ||||||
7 | Sec. 4.2. Suspension of grant making authority. Any grant | ||||||
8 | funds and any grant program administered by a grantor agency | ||||||
9 | subject to this Act are indefinitely suspended on June 30, | ||||||
10 | 2013, January 1, 2013, and on July 1st of every 5th year | ||||||
11 | thereafter, unless the General Assembly, by law, authorizes | ||||||
12 | that grantor agency to make grants or lifts the suspension of | ||||||
13 | the authorization of that grantor agency to make grants. In the | ||||||
14 | case of a suspension of the authorization of a grantor agency | ||||||
15 | to make grants, the authority of that grantor agency to make | ||||||
16 | grants is suspended until the suspension is explicitly lifted |

1 | by law by the General Assembly, even if an appropriation has | ||||||
2 | been made for the explicit purpose of such grants. This | ||||||
3 | suspension of grant making authority supersedes any other law | ||||||
4 | or rule to the contrary.
