AMENDMENT TO SENATE BILL 3638




2    AMENDMENT NO. ______. Amend Senate Bill 3638 on page 10, by 
3replacing lines 14 through 16 with the following:


 
4    "Section 40. Application; exemptions. 
5    (a) No person may act as a sex offender evaluator, sex 
6offender treatment provider, or associate sex offender 
7provider as defined in this Act for the provision of sex 
8offender evaluations or sex offender treatment pursuant to the 
9Sex Offender Management Board Act, the Sexually Dangerous 
10Persons Act, or the Sexually Violent Persons Commitment Act 
11unless the person is licensed to do so by the Department. Any 
12evaluation or treatment services provided by a licensed health 
13care professional not licensed under this Act shall not be 
14valid under the Sex Offender Management Board Act, the Sexually 
15Dangerous Persons Act, or the Sexually Violent Persons 
16Commitment Act.
17    (b) Nothing in this Act shall be construed to require any

1licensed physician, advanced practice nurse, physician 
2assistant, or other health care professional to be licensed 
3under this Act for the provision of services for which the 
4person is otherwise licensed. This Act does not prohibit a

5person licensed under any other Act in this State from engaging

6in the practice for which he or she is licensed. This Act only 
7applies to the provision of sex offender evaluations or sex 
8offender treatment provided for the purposes of complying with 
9the Sex Offender Management Board Act, the Sexually Dangerous 
10Persons Act, or the Sexually Violent Persons Commitment Act."; 
11and 
   
12on page 39, line 20, by inserting "appointed by the Governor" 
13after "member"; and
 
14on page 39, line 25, by inserting "appointed by the Governor" 
15after "member".
