| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Illinois Vehicle Code is amended by changing |
| 5 | | Section 18c-7201 as follows:
|
| 6 | | (625 ILCS 5/18c-7201) (from Ch. 95 1/2, par. 18c-7201)

| 7 | | Sec. 18c-7201. Registration as a Rail Carrier. (1) General |
| 8 | | Provisions.
Except as provided in subsection (2) of this |
| 9 | | Section, no
person shall operate as a rail carrier, and
and no |
| 10 | | person shall
begin or continue construction of any track or |
| 11 | | other
facilities, other than the repair or replacement of |
| 12 | | existing
plant, for use in operations as a rail carrier unless |
| 13 | | such
person has registered with the Commission as a rail |
| 14 | | carrier. |
| 15 | | (2) Exceptions.
Each rail carrier operating within the |
| 16 | | State of Illinois on
the effective date of this Chapter shall |
| 17 | | automatically be deemed,
as of that date, to have registered as |
| 18 | | a rail carrier for
purposes of this Section. Such constructive |
| 19 | | registration
shall expire on the 180th day after the effective |
| 20 | | date of this amendatory Act of 1985.
