AMENDMENT TO SENATE BILL 3780




2    AMENDMENT NO. ______. Amend Senate Bill 3780 on page 7, 
3line 18, after "abuse" by inserting the following:


4", the recipient was an in-patient or resident of a public or 
5private hospital or mental health facility when an alleged 
6sexual assault or sexual abuse occurred,"; and 
 
7on page 8, line 5, after "cause.", by inserting the following:
8"Medical treatment and diagnosis shall be redacted from any 
9records produced unless the court has found that the recipient 
10has been informed as adequately and as effectively as possible 
11of the request for such records.  Non-medical treatment and 
12diagnosis, such as physical characteristics, are not required 
13to be redacted."; and 
 
14on page 8, line 10, after "examination", by inserting the 
15following:
16"For purposes of this paragraph (13), the term "sexual assault"

1shall have the same meaning that the term "criminal sexual 
2assault" is given in Section 11-1.20 in the Criminal Code of 
31961  and the term "sexual abuse" shall have the same meaning 
4that the term "criminal sexual abuse" is given in Section 
511-1.50 in the Criminal Code of 1961.".
