Synopsis As Introduced
Amends the Liquor Control Act of 1934. Makes a technical change in a Section concerning the short title.

Replaces everything after the enacting clause. Amends the Liquor Control Act of 1934. Defines "homemade brewed beverage". Provides that the fee for a homebrewer special event permit is $25. Provides that the making of homemade brewed beverages does not require a license or permit if: the brewer receives no compensation; the homemade brewed beverages are not sold or offered for sale; and the quantity of homemade brewed beverages made by a person in a calendar year does not exceed 100 gallons if the household has only one person of legal drinking age or 200 gallons if the household has 2 or more persons of legal drinking age. Provides that a person who makes, possesses, transports, or stores homemade brewed beverages in compliance with limitations specified is not a brewer, craft brewer, wholesaler, retailer, or manufacturer of beer for the purposes of the Act. Provides that homemade brewed beverages made in compliance with the Act may be consumed by the person who made it and his or her family, neighbors, and friends at any private residence or other private location where the possession and consumption of alcohol is permissible under the Act, local ordinances, and other applicable law if the homemade brewed beverages are not made available for consumption by the general public. Establishes requirements for the use of homemade brewed beverages at a public exhibition, demonstration, tasting, or sampling. Provides that, if a public event using homemade brewed beverages is not held at a private residence, the event organizer shall obtain a homebrewer special event permit for each location. Establishes requirements for conducting, sponsoring, or hosting a contest, competition, or other event for the exhibition, demonstration, judging, tasting, or sampling of homemade brewed beverages. Provides that a commercial enterprise engaged primarily in selling supplies and equipment to the public for use by homebrewers may manufacture homemade brewed beverages for the purpose of tasting the beverages at the location of the commercial enterprise if the homemade brewed beverages are not sold or offered for sale. Provides that homemade brewed beverages are not subject to the provisions of the Act concerning taxation. Effective immediately.
