Synopsis As Introduced
Amends the Department of Transportation Law of the Civil Administrative Code of Illinois. Provides that the Department of Transportation may make low-interest loans from the Working Capital Revolving Loan Fund to disadvantaged business enterprises. Establishes a loan selection committee to review applications and select eligible businesses. Provides that the Department may set eligibility requirements for loans by administrative rule. Provides limitations on the use of loan funds. Provides that loans may be made with interest. Limits the number of loans a business may receive. Provides that the Department shall give annual reports to the Governor and the General Assembly on the program. Provides that the Department's authority to issue loans expires on June 1, 2018. Amends the State Finance Act. Establishes the Working Capital Revolving Loan Fund. Provides for transfers not to exceed $3,000,000 a year, for a period of 5 years, from the Road Fund to the Working Capital Revolving Loan Fund as requested by the Secretary of Transportation. Provides that no transfer will occur if the available balance in the Working Capital Revolving Loan Fund is equal to or greater than $6,000,000. Effective July 1, 2013.

House Floor Amendment No. 3
Replaces everything after the enacting clause. Inserts the provisions of the introduced bill. Provides members of the loan selection committee shall not receive any compensation other than for reasonable expenses for service related to the committee. Provides that the loan agreement shall not extend repayment longer than final payment made by the Department of Transportation following completion and acceptance of the work. Requires the Fund Control Agent to intercept payments made from a contractor to a subcontractor receiving a loan and allows the Fund Control Agent to deduct any unpaid loan repayments owed to the State before releasing the payment to the subcontractor. Requires loans to be made with interest. Provides that the Department shall set interest rates by rule. Reduces the amount that may be loaned from 75% to 55% of the contract or subcontract for which the loan is being made. Requires the Department to notify the prime contractor on a project that a subcontractor on the same project has been awarded a loan from the Working Capital Revolving Loan Fund. Provides that the annual report to the Governor and the General Assembly shall include the names of any contractors who are delinquent or in default of payment and the January 1, 2017 report is to include an evaluation of the program by the Department.
