Synopsis As Introduced
Amends the Environmental Protection Act. Prohibits a person from claiming the on-farm composting exemption from solid-waste permitting if he or she charges a tipping fee. Authorizes a person who is operating an on-farm landscape composting facility to accept food scrap, crop residue, livestock waste, agricultural landscape waste, uncontaminated wood waste, yard waste, and landscape waste for composting and still maintain the on-farm composting permitting exemption so long as the other applicable requirements are satisfied. Effective immediately.

House Committee Amendment No. 1
Replaces everything after the enacting clause. Amends the Environmental Protection Act. Provides that a composting facility may not qualify for the on-farm permit exemption, unless it certifies (i) that it accepts from other agricultural operations for composting with landscape waste no materials other than dry, uncontaminated, and source-separated crop residue and other agricultural plant residue generated from the production and harvesting of crops and other customary farm practices and (ii) that any composting additives that it accepts and uses at the facility are necessary to provide proper conditions for composting and do not exceed 10% of the total composting material at the facility at any one time. Effective immediately.

House Floor Amendment No. 2
Deletes a provision that required crop residue accepted by the facility to be dry. Authorizes the composting facility to accept for composting any plant-derived animal bedding, such as straw or sawdust, that is free of manure and was not made from painted or treated wood. Provides that if a municipality or county in which a composting facility is located has by ordinance approved a setback distance of less than 1/4 mile, then a composting facility located in the boundaries of that unit of government may maintain its on-farm exemption from waste permitting even though it violates the otherwise applicable 1/4 mile setback requirement.

Senate Committee Amendment No. 2
Specifies that an owner or operator qualifies for this permitting exemption only if, among other things, the composting material was placed at a site having not more than 10 occupied non-farm residences within 1/2 mile of its boundaries on the date of application. Makes technical changes.
