Synopsis As Introduced
Amends the Wildlife Code. Makes a technical change in a Section concerning the short title.

Senate Committee Amendment No. 1
Deletes reference to:
520 ILCS 5/1.1
Adds reference to:
520 ILCS 5/2.33from Ch. 61, par. 2.33

Replaces everything after the enacting clause. Amends the Wildlife Code. Provides that it is unlawful for any person to take or attempt to take any species of wildlife or parts thereof (instead of trap or hunt) within or upon the waters or land of another, or to knowingly shoot a gun, bow and arrow, or crossbow onto the property of another for the purposes of taking or attempting to take any species of wildlife, without first obtaining permission from the owner or the owner's designee (instead of the owner or the owner's tenant). Provides that the owner's designee means anyone the owner designates in a written authorization and the authorization must contain (i) the legal or common description of property for such authority is given, (ii) the extent that the owner's designee is authorized to make decisions regarding who is allowed to take or attempt to take any species of wildlife or parts thereof, and (iii) the owner's notarized signature. Removes language that provides that it shall be prima facie evidence that a person does not have permission of the owner or tenant if the person is unable to demonstrate to the law enforcement officer in the field that permission had been obtained and that it may only be rebutted by testimony of the owner or tenant that permission had been given. Effective immediately.

Senate Floor Amendment No. 3
Replaces everything after the enacting clause with the provisions of Senate Amendment No. 1. Further amends the Wildlife Code by providing that it is unlawful for any person to take or attempt to take any species of wildlife or parts thereof within or upon the waters or land of another or to knowingly shoot a gun or bow and arrow device at any wildlife physically on or flying over the property of another (instead of to knowingly shoot a gun, bow and arrow, or crossbow onto the property of another for the purposes of taking or attempting to take any species of wildlife) without first obtaining permission from the owner or the owner's designee. Effective immediately.
