AMENDMENT TO HOUSE BILL 140

2    AMENDMENT NO. ______. Amend House Bill 140 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Employees Group Insurance Act of 1971
5is amended by adding Sections 2.5, 2.6, 2.7, and 2.8 as
6follows:
 
7    (5 ILCS 375/2.5 new)
8    Sec. 2.5. Application to Regional Transportation Authority
9Board members. Notwithstanding any other provision of this Act
10to the contrary, this Act does not apply to any member of the
11Regional Transportation Authority Board with respect to
12service on that Board during a term of office that begins on or
13after the effective date of this amendatory Act of the 98th
14General Assembly.

2    Sec. 22-105. Application to Regional Transportation

3    Section 15. The Metropolitan Transit Authority Act is
4amended by changing Sections 19 and 22 as follows:

6    Sec. 19. Compensation; pension; benefits.
7    (a) The governing and administrative body of the Authority
8shall be a board consisting of seven members, to be known as
9Chicago Transit Board. Members of the Board shall be residents
10of the metropolitan area and persons of recognized business
11ability. No member of the Board of the Authority shall hold any
12other office or employment under the Federal, State or any
13County or any municipal government except an honorary office
14without compensation or an office in the National Guard. No
15employee of the Authority shall hold any other office or
16employment under the Federal, State or any County or any
17municipal government except an office with compensation not
18exceeding $15,000 annually or a position in the National Guard
19or the United States military reserves. Provided, however, that
20the Chairman may be a member of the Board of the Regional
21Transportation Authority. No member of the Board or employee of
22the Authority shall have any private financial interest, profit
23or benefit in any contract, work or business of the Authority
24nor in the sale or lease of any property to or from the

1Authority.
2    (b) The provisions of this subsection (b) apply only for
3terms of office beginning before the effective date of this
4amendatory Act of the 98th General Assembly. The salary of each
5member of the initial Board shall be $15,000.00 per annum, and
6such salary shall not be increased or diminished during his or
7her term of office. The salaries of successor members of the
8Board shall be fixed by the Board and shall not be increased or
9diminished during their respective terms of office. No Board
10member shall be allowed any fees, perquisites or emoluments,
11reward or compensation for his or her services as a member or
12officer of the Authority aside from his or her salary or
13pension, but he or she shall be reimbursed for actual expenses
14incurred by him or her in the performance of his or her duties.
15    (c) For terms of office beginning on or after the effective
16date of this amendatory Act of the 98th General Assembly,
17members of the Board shall be compensated $500 for attendance
18at each meeting of the Board and for actual expenses incurred
19in travel to and from those meetings but shall not be otherwise
20compensated for service as a member of the Board.
21    For individuals who first become members of the Board on or
22after the effective date of this amendatory Act of the 98th
23General Assembly, no service or contribution shall be credited
24in any retirement system or pension fund, under the Illinois
25Pension Code or otherwise, for service on the Board, and no
26public funds shall be appropriated, expended, or otherwise

1obligated for such a retirement system or pension fund credit.
2For terms of office beginning on or after the effective date of
3this amendatory Act of the 98th General Assembly, neither the
4chairperson nor any other member of the Board shall be entitled
5to participate in a program of life or health insurance as a
6consequence of his or her service on the Board.

9    Sec. 22. Chairperson; terms; compensation. As soon as
10possible after the appointment of the initial members, the
11board shall organize for the transaction of business, select a
12chairman and a temporary secretary from its own number, and
13adopt by-laws, rules and regulations to govern its proceedings.
14The initial chairman and successors shall be elected by the
15Board from time to time for the term of his or her office as a
16member of the Board or for the term of three years, whichever
17is shorter.
18    The Board shall fix the salary of the chairperson chairman
19in addition to his salary as a member of the Board, which shall
20not be increased or diminished during his or her term of office
21as chairperson chairman. But if the chairperson chairman is
22engaged in any other business or employment during his or her
23term as chairperson chairman, his or her annual salary shall be
24not more than $25,000.

6obligated for such a retirement system or pension fund credit.
7For terms of office beginning on or after the effective date of
8this amendatory Act of the 98th General Assembly, neither the
9chairperson nor any other member of the Board shall be entitled
10to participate in a program of life or health insurance as a
11consequence of his or her service on the Board.

13    Section 25. The Regional Transportation Authority Act is
14amended by changing Sections 2.17, 3.04, 3A.06, and 3B.06 as
15follows:

17    Sec. 2.17. Employee Pensions.
18    (a) The Authority may establish and maintain systems of
19pensions and retirement benefits for such officers and
20employees of the Authority as may be designated or described by
21ordinance of the Authority; may fix the classifications
22therein; may take such steps as may be necessary to provide
23that persons eligible for admission to such pension systems as
24officers and employees of the Authority or of any

1transportation agency whose operations are financed in whole or
2in part by the Authority, shall retain eligibility for
3admission to or continued coverage and participation under
4Title II of the federal Social Security Act, as amended, and
5the related provisions of the Federal Insurance Contributions
6Act, as amended, or the federal Railroad Retirement Act, as
7amended, and the related provisions of the Railroad Retirement
8Tax Act, as amended, as the case may be; and may provide in
9connection with such pension systems, a system of benefits
10payable to the beneficiaries and dependents of any participant
11in such pension systems after the death of such participant
12(whether accidental or otherwise, whether occurring in the
13actual performance of duty or otherwise, or both) subject to
14such exceptions, conditions, restrictions and classifications
15as may be provided by ordinance of the Authority. Such pension
16systems shall be financed or funded by such means and in such
17manner as may be determined by the Authority to be economically
18feasible.
19    (b) Beginning on the effective date of this amendatory Act
20of the 98th General Assembly, the Authority shall not grant any
21new benefit increase. As used in this subsection (b), "new
22benefit increase" means (i) an increase in the amount of any
23benefit provided under the authority of an ordinance adopted
24under this Section that takes effect after the effective date
25of this amendatory Act of the 98th General Assembly and (ii) an
26expansion of the conditions of eligibility for any benefit

1provided under the authority of an ordinance adopted under this
2Section that takes effect after the effective date of this
3amendatory Act of the 98th General Assembly.

21effective date of this amendatory Act of the 98th General
22Assembly, the Chairman of the Chicago Transit Authority shall
23not be compensated by the Authority.

14file and publish statements of the receipts and disbursements
15thereof", approved June 24, 1919, as now or hereafter amended.
