AMENDMENT TO HOUSE BILL 181 




2    AMENDMENT NO. ______. Amend House Bill 181 by replacing 
3everything after the enacting clause with the following:

 
 
4    "Section 5. The Unified Code of Corrections is amended  by 
5changing Section 5-9-1.14 as follows:
 
6    (730 ILCS 5/5-9-1.14)
7    Sec. 5-9-1.14. Additional child pornography fines. In 
8addition to any other penalty imposed, a fine of $500 shall be 
9imposed upon a person convicted of child pornography under 
10Section 11-20.1 of the Criminal Code of 1961 or the Criminal 
11Code of 2012.  The Such additional fine shall be assessed by the 
12court imposing sentence and shall be collected by the circuit 
13clerk.  Of this fee, $5 shall be deposited into the Circuit 
14Court Clerk Operation and Administrative Fund created by the 
15circuit clerk Clerk of the Circuit Court to be used to offset 
16the costs incurred by the circuit clerk Circuit Court Clerk in

1performing the additional duties required to collect and 
2disburse funds to entities of State and local government as 
3provided by law.  Each such additional fine shall be remitted by 
4the circuit clerk Circuit Court Clerk within one month after 
5receipt  to the unit of local or State government whose law 
6enforcement officers investigated the case that gave rise to 
7the conviction of the defendant for child pornography. When 
8Department of State Police officers investigated the case that 
9gave rise to the conviction of the defendant for child 
10pornography,  the additional fine shall be remitted by the 
11circuit clerk within one month after receipt to the State 
12Treasurer for deposit into the State Crime Laboratory Fund.   
13When the Department of State Police provides digital or 
14electronic forensic examination assistance, or both,  to 
15another law enforcement agency which investigated the case that 
16gave rise to the conviction of the defendant for child 
17pornography, $100 of the additional fine shall be remitted by 
18the circuit clerk within one month after receipt to the State 
19Treasurer for deposit into the State Crime Laboratory Fund.
