AMENDMENT TO HOUSE BILL 440




2    AMENDMENT NO. ______. Amend House Bill 440 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Illinois Highway Code is amended  by 
5changing Section 6-130 as follows:
 



6    (605 ILCS 5/6-130)  (from Ch. 121, par. 6-130)



7    Sec. 6-130. Notwithstanding any other provision of this Act 
8to the contrary,
no
township road district may continue in 
9existence if the roads forming a
part of the district do not 
10exceed a total of 15 4 miles in length. For purposes of this 
11Section, the roads forming a part of a township road district 
12include those roads maintained by the district, regardless of 
13whether or not those roads are owned by the township. On the 
14first Tuesday in April of 2017, or of any subsequent year next 
15succeeding the reduction of a township road system to a total 
16mileage of 15 miles or less, each such township road district

1shall, by operation of law, be abolished. On the
first Tuesday 
2in April of 1975, or of any subsequent year next succeeding
the 
3reduction of a township road system to a total mileage of 4 
4miles or
less, each such township road district shall, by 
5operation of law, be
abolished. The roads comprising that 
6district at that time shall thereafter
be administered by the 
7township board of trustees by contracting with the
county, a 
8municipality or a private contractor.  The township board of 
9trustees
shall assume all taxing authority of a township road 
10district abolished under
this Section.

12    Section 99. Effective date. This Act takes effect upon 
13becoming law.".
