| 4 | | "Section 5. The Illinois Municipal Code is amended by |
| 5 | | adding Section 11-42-15 as follows:

| 7 | | Sec. 11-42-15. Tobacco stores. The corporate authorities |
| 8 | | of each municipality may regulate, locate, and prohibit retail |
| 9 | | tobacco stores. For the purposes of this Section, "retail |
| 10 | | tobacco store" has the definition prescribed in Section 10 of |
| 11 | | the Smoke Free Illinois Act. |
| 12 | | This Section applies only to tobacco stores opened after |
| 13 | | the effective date of this amendatory Act of the 98th General |
| 14 | | Assembly and to existing tobacco stores that change ownership |
| 15 | | after the effective date of this amendatory Act of the 98th |
| 16 | | General Assembly.".
