| 1 | AN ACT concerning local government.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Fire Protection District Act is amended by | ||||||
| 5 | adding Section 11j as follows: | ||||||
| 6 | (70 ILCS 705/11j new) | ||||||
| 7 | Sec. 11j. Installation of access or key boxes. The board of | ||||||
| 8 | trustees of any fire protection district may, by ordinance, | ||||||
| 9 | require the installation of an access or key box if: (1) a | ||||||
| 10 | structure is protected by an automatic fire alarm or security | ||||||
| 11 | system or access to or within the structure or area is unduly | ||||||
| 12 | difficult because of secured openings; and (2) immediate access | ||||||
| 13 | is necessary for life-saving purposes. In the case of a health | ||||||
| 14 | care facility that is secured by an electronic code box that is | ||||||
| 15 | in good working order, if the owner of the health care facility | ||||||
| 16 | provides the fire department with a valid access code, then | ||||||
| 17 | that health care facility is not required to be accessible by | ||||||
| 18 | an access or key box. For the purposes of this Section, "health | ||||||
| 19 | care facility" means: a hospital licensed under the Hospital | ||||||
| 20 | Licensing Act or the University of Illinois Hospital Act; a | ||||||
| 21 | nursing home or long-term care facility licensed under the | ||||||
| 22 | Nursing Home Care Act; an assisted living establishment, as | ||||||
| 23 | defined in the Assisted Living and Shared Housing Act; a mental | ||||||

| 1 | health facility, as defined in the Mental Health and | ||||||
| 2 | Developmental Disabilities Code; a supportive living facility | ||||||
| 3 | certified to participate in the supportive living facilities | ||||||
| 4 | program under Section 5-5.01a of the Illinois Public Aid Code; | ||||||
| 5 | or a facility licensed under the Specialized Mental Health | ||||||
| 6 | Rehabilitation Act. "Access or key box" means a secure device | ||||||
| 7 | with a lock operable only by a fire department master key, and | ||||||
| 8 | containing building entry keys and other keys that may be | ||||||
| 9 | required for access in an emergency. | ||||||
| 10 | The access or key box shall be of an approved type listed | ||||||
| 11 | in accordance with the most recently published version of the | ||||||
| 12 | standard Underwriters Laboratories 1037 and shall contain keys | ||||||
| 13 | to gain access as required by the fire chief of the fire | ||||||
| 14 | protection district, or his or her designee. | ||||||
| 15 | An ordinance enacted under this Section may specify | ||||||
| 16 | particular classes or types of structures or occupancies that | ||||||
| 17 | are required to install an access or key box. However, an | ||||||
| 18 | ordinance enacted under this Section shall not apply to single | ||||||
| 19 | family residential structures or to facilities owned or | ||||||
| 20 | operated by a public utility, as that term is defined under | ||||||
| 21 | Section 3-105 of the Public Utilities Act.

| 22 | Section 99. Effective date. This Act takes effect upon | ||||||
| 23 | becoming law.
