AMENDMENT TO HOUSE BILL 1984

2    AMENDMENT NO. ______. Amend House Bill 1984 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Finance Act is amended by adding
5Sections 5.826 and 6z-98 as follows:
 
6    (30 ILCS 105/5.826 new)
7    Sec. 5.826. The School Consolidation Aid Fund.
 
8    (30 ILCS 105/6z-98 new)
9    Sec. 6z-98. The School Consolidation Aid Fund. The School
10Consolidation Aid Fund is created as a special fund in the
11State treasury. Subject to appropriation, the moneys in the
12Fund shall be used by the State Board of Education solely for
13supplemental grants to school districts that are undergoing
14consolidation or planning for consolidation. The State Board of
15Education shall create, by administrative rule, the process to

1be used by school districts to apply for the grants. Nothing in
2the supplemental school district consolidation grant
3application process shall affect the eligibility of a school
4district to also receive all of its shares of other forms of
5State school aid. All interest earned on moneys in the Fund
6shall be deposited into the Fund. The Fund shall not be subject
7to administrative charges or chargebacks, including, but not
8limited to, those authorized under Section 8h.
 
9    Section 10. The Video Gaming Act is amended by changing
10Section 60 as follows:
 
11    (230 ILCS 40/60)
12    Sec. 60. Imposition and distribution of tax.
13    (a) A tax of 30% is imposed on net terminal income and
14shall be collected by the Board.
15    (b) Of the tax collected under this Section, until the
16effective date of this amendatory Act of the 98th General
17Assembly, five-sixths shall be deposited into the Capital
18Projects Fund and one-sixth shall be deposited into the Local
19Government Video Gaming Distributive Fund.
20    (b-5) Beginning on the effective date of this amendatory
21Act of the 98th General Assembly, of the tax collected under
22this Section, one-sixth shall be transferred into the Local
23Government Video Gaming Distributive Fund and five-sixths
24shall be transferred to the Capital Projects Fund and the

1School Consolidation Aid Fund as determined by administrative
2rule adopted jointly by the Governor's Office of Management and
3Budget and the Treasurer. No later than July 1, 2013, the
4Governor's Office of Management and Budget and the Treasurer
5shall determine the amount of tax revenues under this Section
6paid into the Capital Projects Fund pursuant to this Act that
7have already been pledged by indenture by the State as revenue
8streams to service bonds that have already been sold by the
9State. All revenues not already pledged by indenture by the
10State for capital spending shall be deposited into the School
11Consolidation Aid Fund. No later than August 1, 2013, the
12Governor's Office of Management and Budget and the Treasurer
13shall jointly publish a rule to redivide that revenues. The
14Governor's Office of Management and Budget and the Treasurer
15shall exercise emergency rulemaking authority under the
16Illinois Administrative Procedure Act to adopt any emergency
17rules necessary for the implementation of this Article.
18    (c) Revenues generated from the play of video gaming
19terminals shall be deposited by the terminal operator, who is
20responsible for tax payments, in a specially created, separate
21bank account maintained by the video gaming terminal operator
22to allow for electronic fund transfers of moneys for tax
23payment.
24    (d) Each licensed establishment, licensed truck stop
25establishment, licensed fraternal establishment, and licensed
26veterans establishment shall maintain an adequate video gaming

1fund, with the amount to be determined by the Board.
2    (e) The State's percentage of net terminal income shall be
3reported and remitted to the Board within 15 days after the
415th day of each month and within 15 days after the end of each
5month by the video terminal operator. A video terminal operator
6who falsely reports or fails to report the amount due required
7by this Section is guilty of a Class 4 felony and is subject to
8termination of his or her license by the Board. Each video
9terminal operator shall keep a record of net terminal income in
10such form as the Board may require. All payments not remitted
11when due shall be paid together with a penalty assessment on
12the unpaid balance at a rate of 1.5% per month.

14    Section 99. Effective date. This Act takes effect upon
15becoming law.".
