AMENDMENT TO HOUSE BILL 2396




2    AMENDMENT NO. ______. Amend House Bill 2396 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Election Code is amended  by changing 
5Section 28-8 as follows:
 



6    (10 ILCS 5/28-8)  (from Ch. 46, par. 28-8)



7    Sec. 28-8. If a referendum held in accordance with Section 
828-7 of this
Act involved
 the question of whether a unit of 
9local government shall
become a home rule unit or shall cease 
10to be a home rule unit and if that referendum passed, then the 
11clerk
of that unit of local government shall, within 45
 days 
12after the
referendum,
 file with the Secretary of State a 
13certified
statement showing the results of the referendum and 
14the resulting status
of the unit of local government as a home 
15rule unit or a non-home rule
unit. The Secretary of State shall 
16maintain such certified statements in
his office as a public

2    The question of whether a unit of local government shall 
3become a home rule unit shall be submitted in substantially the 
4following form: 
5    Shall (name of the unit of local government) become a home 
6    rule unit? 
7    Votes must be recorded as "yes" or "no". 
 
8    The question of whether a unit of local government shall 
9cease to be a home rule unit shall be submitted in 
10substantially the following form: 
11    Shall (name of the unit of local government) cease to be a 
12    home rule unit?
13    Votes must be recorded as "yes" or "no".
