| 1 | AN ACT concerning local government.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Counties Code is amended by adding Section | ||||||
| 5 | 5-1183 as follows: | ||||||
| 6 | (55 ILCS 5/5-1183 new) | ||||||
| 7 | Sec. 5-1183. Donation bins. | ||||||
| 8 | (a) Notwithstanding any other provision of law, a donation | ||||||
| 9 | bin in any county shall have a permanent, written, printed | ||||||
| 10 | label affixed to the bin and prominently displayed. The label | ||||||
| 11 | shall include the name, address, and telephone number of the | ||||||
| 12 | person or entity owning, operating, or maintaining that bin. | ||||||
| 13 | Any entity that does not meet the criteria for a "not for | ||||||
| 14 | profit" designation shall label its bin as "for profit". Any | ||||||
| 15 | entity that does meet the criteria for "not for profit" shall | ||||||
| 16 | label its bin as "not for profit". | ||||||
| 17 | (b) As used in this Section: | ||||||
| 18 | "Donation bin" or "bin" means a container or receptacle | ||||||
| 19 | held out to the public as a place for people to donate | ||||||
| 20 | clothes, shoes, and books and to store them until taken | ||||||
| 21 | away for donation or resale by the entity that owns, | ||||||
| 22 | operates, or maintains the bin. | ||||||
| 23 | "Not for profit" means any entity that is officially | ||||||

| 1 | recognized by the United States Internal Revenue Service as | ||||||
| 2 | a tax-exempt entity described in Section 501(c)(3) of the | ||||||
| 3 | Internal Revenue Code of 1986 (or any successor provision | ||||||
| 4 | of federal tax law). | ||||||
| 5 | Section 10. The Illinois Municipal Code is amended by | ||||||
| 6 | adding Section 11-42-15 as follows: | ||||||
| 7 | (65 ILCS 5/11-42-15 new) | ||||||
| 8 | Sec. 11-42-15. Donation bins. | ||||||
