Amends the Unemployment Insurance Act. Provides that the Department of Employment Security shall periodically ascertain the average weekly household income for Illinois households. Provides that, if the wages of an otherwise eligible individual who is a part-time worker in a week, combined with the individual's weekly benefit amount, do not exceed the lesser of the individual's final regular wages, not including overtime or bonuses, at the individual's last full-time position the average weekly household income for Illinois households, then the individual is eligible to receive the same weekly benefit amount to which the eligible individual would be entitled if he or she were not working part-time. Provides for a reduced weekly benefit amount under specified circumstances. Provides that benefits under the new provisions are available only during an individual's period of regular benefits and not during any period of extended benefits. Provides that, if an individual who is a part-time worker in a week is eligible for benefits under any other provision of the Act or rule of the Department in amount that is greater than the amount to which an individual is eligible for benefits under the new provisions, then that other provision or rule shall control.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Unemployment Insurance Act is amended by |
5 | | adding Section 407.1 as follows: |
6 | | (820 ILCS 405/407.1 new) |
7 | | Sec. 407.1. Benefits for certain part-time workers; |
8 | | alternate formula. |
9 | | (a) The Department shall periodically ascertain the |
10 | | average weekly household income for Illinois households. |
11 | | (b) As used in this Section only, "ceiling" means the |
12 | | lesser of the following: |
13 | | (1) An individual's final regular wages, not including |
14 | | overtime or bonuses, at the individual's last full-time |
15 | | position. |
16 | | (2) The average weekly household income for Illinois |
17 | | households ascertained under subsection (a). |
18 | | (b) Notwithstanding any other provision of law, if the |
19 | | wages of an otherwise eligible individual who is a part-time |
20 | | worker in a week combined with the individual's weekly benefit |
21 | | amount do not exceed the ceiling, then the individual is |
22 | | eligible to receive the same weekly benefit amount to which the |
23 | | eligible individual would be entitled if he or she were not |
