AMENDMENT TO HOUSE BILL 3255

2    AMENDMENT NO. ______. Amend House Bill 3255 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Public Demonstrations Law is
5amended by changing Sections 3, 4, 5, and 6 as follows:
 
6    (430 ILCS 70/3)  (from Ch. 38, par. 85-3)
7    Sec. 3. Unlawful action-Parade permit.
8    It is unlawful for any person, group or organization to
9conduct or participate in any march, assembly, meeting, parade,
10or gathering on roadways in more than one specific area of or
11location in, any municipality or the unincorporated area of a
12county, on any given day, unless it is acting under authority
13of a duly issued municipal or county parade or demonstration
14permit if local ordinance or regulation requires a such permit,
15or, if not, with permission of the principal law enforcement
16officer for the such area. Only the person, group, or

1organization responsible for organizing the march, assembly,
2meeting, parade, or gathering is required to obtain a permit or
3the permission of the principal law enforcement officer, which
4shall be sufficient to encompass all participants. If a march,
5assembly, meeting, parade, or gathering on roadways involves
6the act of crossing or traversing over or upon active railroad
7tracks, the municipal or county authority or principal law
8enforcement officer, as part of its permit or permission
9process, may prohibit any portion of the route that involves
10the act of crossing or traversing over or upon active railroad
11tracks.

14    Sec. 4. Acting with other groups - Size of assemblage. It
15is unlawful for any group or organization or any individual
16acting with the such group or organization, to conduct or
17participate in any march, assembly, meeting, parade, or
18gathering on roadways unless the such march, assembly, meeting,
19parade, or gathering is limited to such numbers that as, in the
20opinion of the principal law enforcement officer, will not
21obstruct pedestrian or vehicular traffic in an unreasonable
22manner. The principal law enforcement officer shall, within 12
23hours of receiving the notice required by Section 5, inform the
24group or organization as to the limitation on number of persons
25allowed to participate.

3    Sec. 5. Notice of assemblage in writing-Contents.
4    It is unlawful for any group or organization to conduct or
5participate in any march, assembly, meeting, parade, or
6gathering on roadways unless the principal law enforcement
7officer has been given notice in writing of the location, the
8maximum number of persons participating, and the names and
9addresses of the organizers of the any such march, assembly,
10meeting, parade, or gathering, its route, and its time of
11inception and duration at least 24 hours before such inception.

14    Sec. 6. Time of holding.
15    It is unlawful for any group, organization, or any
16individual to conduct or participate in any march, assembly,
17meeting, parade, or gathering on roadways during peak traffic
18periods unless authorized by the principal law enforcement
19officer for the area in which the march, assembly, meeting,
20parade, or gathering is to be held. Peak traffic periods,
21unless otherwise set by municipal or county authority, are for
22the purposes of this Act declared to be 7:30 a.m. o'clock to
239:00 a.m. o'clock in the forenoon, and from 4:30 p.m. o'clock
24to 6:00 p.m. o'clock in the afternoon, Monday through Friday
