AMENDMENT TO HOUSE BILL 3820




2    AMENDMENT NO. ______. Amend House Bill 3820, AS AMENDED, 
3with reference to page and line numbers of House Amendment No. 
41, as follows:
 
5on page 32, line 10, after the period, by inserting "The 
6Governor's Office of Management and Budget shall adopt rules 
7governing the criteria to be considered when an exception is 
8requested."; and
 
9by replacing line 19 on page 35 through line 2 on page 36 with 
10the following:
 
11    "Section 70. Exceptions. 
12    (a) With the exception of the audit requirements set forth 
13in 2 CFR 200.102, the Governor's Office of Management and 
14Budget may allow exceptions for classes of State or federal 
15pass-through awards or non-federal entities subject to the

1requirements of this Act when such exceptions are not 
2prohibited by State or federal law.  However, in the interest of 
3maximum uniformity, exceptions from the requirements of this 
4Act shall be permitted only in unusual or exceptional 
5circumstances.
6    (b) The Governor's Office of Management and Budget shall 
7adopt rules governing the criteria that shall be used to 
8determine when an exception may be issued.  The Governor's 
9Office of Management and Budget shall publish any allowed 
10exceptions in the Catalogue of State Financial Assistance 
11within 30 days of the exception being allowed."; and
 
12on page 55, by replacing line 5 with the following:


13    "(k) This Section is repealed on July 1, 2019 April 1, 
142014.".
