1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Abraham Lincoln Presidential Library and Museum Act.
 
6    Section 5. Definitions. For the purposes of this Act:
7    "Agency" means the Abraham Lincoln Presidential Library
8and Museum.
9    "Board" means the Board of the Abraham Lincoln Presidential
10Library and Museum.
11    "Executive Director" means the Executive Director of the
12Abraham Lincoln Presidential Library and Museum.
13    "Library" means the Abraham Lincoln Presidential Library.
14    "Museum" means the Abraham Lincoln Presidential Museum.
 
15    Section 10. Abraham Lincoln Presidential Library and
16Museum; establishment; Foundation.
17    (a) The Abraham Lincoln Presidential Library and Museum,
18formerly a constituent unit of the Illinois Historic
19Preservation Agency, is created as an independent State agency.
20    (b) The Agency shall be under the supervision and direction
21of the Executive Director of the Abraham Lincoln Presidential
22Library and Museum.

1    (c) There shall be a Board of the Abraham Lincoln
2Presidential Library and Museum to advise the Abraham Lincoln
3Presidential Library and Museum and the Executive Director on
4programs related to the Abraham Lincoln Presidential Library
5and Museum. The Abraham Lincoln Presidential Library and Museum
6and the Abraham Lincoln Presidential Library Foundation shall
7mutually co-operate to maximize resources available to the
8Abraham Lincoln Presidential Library and Museum and to support,
9sustain, and provide educational programs and collections at
10the Abraham Lincoln Presidential Library and Museum.
 
11    Section 15. Board; initial members.
12    (a) The Board of the Abraham Lincoln Presidential Library
13and Museum shall consist of 11 members to be appointed by the
14Governor, with the advice and consent of the Senate. Each of
15these members shall have recognized knowledge and ability in
16matters relating to history, research, cultural institutions,
17archives, libraries, business, or education. The terms of
18office of these members shall be 6 years, except that the terms
19of office of the initial members shall commence from the
20effective date of this Act and run as provided under subsection
21(b) of this Section.
22    (b) The appointees that currently serve, as of the
23effective date of this Act, on the Advisory Board of the
24Lincoln Presidential Library and Museum previously created
25under Section 30 of the Historic Preservation Agency Act (now

1repealed) shall serve as the initial members of the Board
2created under Section 10 of this Act until they complete the
3unexpired portions of the terms to which they were appointed
4under Section 31 of the Historic Preservation Agency Act (now
5repealed) or until the Governor appoints a successor to replace
6the initial member. Successors, including a new Chairperson,
7shall be appointed by the Governor in accordance with
8subsection (a) of this Section.
 
9    Section 20. Powers and duties of the Board. The Board shall
10have the following powers and duties:
11    (a) Establish programs for implementation in support of the
12mission and goals of the Abraham Lincoln Presidential Library
13and Museum.
14    (b) Create and execute such seminars, symposia, or other
15conferences as may be necessary or advisable to the Abraham
16Lincoln Presidential Library and Museum.
17    (c) Report annually to the Governor and the General
18Assembly on the status of the Abraham Lincoln Presidential
19Library and Museum and its programs.
20    (d) Hire agents and employees necessary to carry out the
21duties and purposes of the Abraham Lincoln Presidential Library
22and Museum.
23    (e) Accept, hold, maintain, and administer, as trustee,
24property given in trust for educational or historic purposes
25for the benefit of the people of the State of Illinois and to

1dispose of any property under the terms of the instrument
2creating the trust.
3    (f) Accept, hold, maintain, and administer donated
4property of historical significance such as books, papers,
5records, and personal property of any kind, including
6electronic and digital property, pursuant to gifting
7instruments, agreements, or deeds of gift and to enter into
8such agreements as may be necessary to carry out the Board's
9duties and responsibilities under this Section.
10    (g) Lease concessions at the Library and Museum. All
11leases, for whatever period, shall be made subject to the
12written approval of the Governor. All concession leases
13extending for a period in excess of 10 years shall contain
14provisions for the Abraham Lincoln Presidential Library and
15Museum to participate, on a percentage basis, in the revenues
16generated by any concession operation.
17    (h) Enforce the laws of the State and the rules of the
18Abraham Lincoln Presidential Library and Museum at the Library
19and Museum.
20    (i) Cooperate with private organizations and agencies of
21the State of Illinois by providing areas and the use of staff
22personnel where feasible for the sale of publications on the
23historic and cultural heritage of the State and craft items
24made by Illinois craftsmen. These sales shall not conflict with
25existing concession agreements. The Board is authorized to
26negotiate and approve agreements with the organizations and

1agencies for a portion of the monies received from sales to be
2returned to the Abraham Lincoln Presidential Library and Museum
3for the furtherance of interpretive and restoration programs.
4    (j) Establish local bank or savings and loan association
5accounts, upon the written authorization of the Executive
6Director, to temporarily hold income received at any of its
7properties. The local accounts established under this
8subsection shall be in the name of the Abraham Lincoln
9Presidential Library and Museum and shall be subject to regular
10audits. The balance in a local bank or savings and loan
11association account shall be forwarded to the Abraham Lincoln
12Presidential Library and Museum for deposit with the State
13Treasurer on Monday of each week if the amount to be deposited
14in a fund exceeds $500.
15    No bank or savings and loan association shall receive
16public funds as permitted by this Section, unless it has
17complied with the requirements established under Section 6 of
18the Public Funds Investment Act.
19    (k) Accept offers of gifts, gratuities, or grants from the
20federal government, its agencies, or offices, or from any
21person, firm, or corporation.
22    (l) Subject to the provisions of the Illinois
23Administrative Procedure Act, make reasonable rules as may be
24necessary to discharge the duties of the Abraham Lincoln
25Presidential Library and Museum.
26    (m) Charge and collect admission fees and rental for access

1to and use of the facilities of the Library and Museum.
2    (n) Operate a restaurant, café, or other food serving
3facility at the Museum or to lease the operation of such a
4facility under reasonable terms and conditions; to provide
5vending services for food, beverages, or other products deemed
6necessary and proper, consistent with the mission and purposes
7of the Library and Museum.
8    (o) To engage in marketing activities designed to promote
9the Library and Museum. In undertaking these activities, the
10Board may take all necessary steps with respect to products and
11services, including, but not limited to, retail sales,
12wholesale sales, direct marketing, mail order sales, telephone
13sales, advertising and promotion, purchase of product and
14materials inventory, design, printing and manufacturing of new
15products, reproductions, and adaptations, copyright and
16trademark licensing and royalty agreements, and payment of
17applicable taxes. In addition, the Board shall have the
18authority to sell advertising in its publications and printed
19materials.
 
20    Section 25. Administration of the Abraham Lincoln
21Presidential Library and Museum. The Board shall appoint an
22Executive Director of the Abraham Lincoln Presidential Library
23and Museum. The Executive Director shall serve at the pleasure
24of the Board. The Executive Director shall, subject to
25applicable provisions of law, execute and discharge the powers

1and duties of the Abraham Lincoln Presidential Library and
2Museum. The Executive Director shall appoint: (a) a Library
3Facilities Operations Director; and (b) a Director of the
4Library. The Executive Director shall appoint those other
5employees of the Abraham Lincoln Presidential Library and
6Museum and the Illinois State Historical Library as he or she
7deems appropriate and shall fix the compensation of the Library
8Facilities Operations Director, the Director of the Library,
9and other employees. The Executive Director may establish and
10collect admission and registration fees, may operate a gift
11shop, and may publish and sell educational and informational
12materials.
 
13    Section 30. Gifts to the Illinois State Historical Library.
14Those programs, collections, and functions heretofore
15administered by the Illinois State Historical Library or the
16Historical Preservation Agency's Historical Library Division
17shall be administered by the Abraham Lincoln Presidential
18Library and Museum. All gifts made specifically to the Illinois
19State Historical Library or the Historical Preservation
20Agency's Historical Library Division shall remain at all times
21within the Abraham Lincoln Presidential Library and Museum.
 
22    Section 35. Director of the Abraham Lincoln Presidential
23Library; historical collections. The Director of the Library
24may and is hereby required to make all necessary rules,

1regulations, and bylaws not inconsistent with law to carry into
2effect the purposes of this Section in accordance with the
3State Historical Library Act and to procure from time to time
4as may be possible and practicable, at reasonable cost, all
5books, pamphlets, manuscripts, monographs, writings, and other
6material of historical interest and useful to the historian
7bearing upon the political, physical, religious, or social
8history of the State of Illinois from the earliest known period
9of time. The Director of the Library may exchange any books,
10pamphlets, manuscripts, records, or other material which such
11library may acquire that are of no historical interest or for
12any reason are of no value to it, with any other library,
13school, or historical society. The Director of the Library
14shall distribute volumes of the series known as the Illinois
15Historical Collections now in print, and to be printed, to all
16who may apply for same and who pay to the Library for such
17volumes an amount fixed by the Director sufficient to cover the
18expenses of printing and distribution of each volume received
19by such applicants. However, the Director of the Library shall
20have authority to furnish not to exceed 25 of each of the
21volumes of the Illinois Historical Collections, free of charge
22to each of the authors and editors of the collections or parts
23thereof; to furnish, as in his or her discretion he or she
24deems necessary or desirable, a reasonable number of each of
25the volumes of the Collections without charge to archives,
26libraries, and similar institutions from which material has

1been drawn or assistance has been given in the preparation of
2such Collections, and to the officials thereof; to furnish, as
3in his or her discretion he or she deems necessary or
4desirable, a reasonable number of each of the volumes of the
5Collections without charge to the University of Illinois
6Library and to instructors and officials of that University,
7and to public libraries in the State of Illinois. The Director
8of the Library may also make exchanges of Historical
9Collections with any other library, school, or historical
10society, and to distribute volumes of collections for review
11purposes.
 
12    Section 40. Separation from Historic Preservation Agency.
13On the effective date of this Act, all of the powers, duties,
14assets, liabilities, employees, contracts, property, including
15any items formerly contained in the Illinois State Historical
16Library now presently held in the Abraham Lincoln Presidential
17Library and Museum, records, pending business, and unexpended
18appropriations of the Historic Preservation Agency related to
19the administration and enforcement of Sections 17, 30, 31, 32,
20and 33 of the Historic Preservation Agency Act (now repealed)
21are transferred to the Abraham Lincoln Presidential Library and
22Museum created under this Act.
23    The status and rights of the transferred employees, and the
24rights of the State of Illinois and its agencies, under the
25Personnel Code and applicable collective bargaining agreements

1or under any pension, retirement, or annuity plan are not
2affected (except as provided in Sections 14-110 and 18-127 of
3the Illinois Pension Code) by that transfer or by any other
4provision of this Act.
 
5    Section 45. The Executive Reorganization Implementation
6Act is amended by changing Section 3.1 as follows:
 
7    (15 ILCS 15/3.1)  (from Ch. 127, par. 1803.1)
8    Sec. 3.1. "Agency directly responsible to the Governor" or
9"agency" means any office, officer, division, or part thereof,
10and any other office, nonelective officer, department,
11division, bureau, board, or commission in the executive branch
12of State government, except that it does not apply to any
13agency whose primary function is service to the General
14Assembly or the Judicial Branch of State government, or to any
15agency administered by the Attorney General, Secretary of
16State, State Comptroller or State Treasurer. In addition the
17term does not apply to the following agencies created by law
18with the primary responsibility of exercising regulatory or
19adjudicatory functions independently of the Governor:
20    (1) the State Board of Elections;
21    (2) the State Board of Education;
22    (3) the Illinois Commerce Commission;
23    (4) the Illinois Workers' Compensation Commission;
24    (5) the Civil Service Commission;

8    Section 50. The Historic Preservation Agency Act is amended
9by changing Sections 2, 4, 5, 5.1, 6, 11, 12, 13, 14, 15, 16,

5    Sec. 4. The Board shall be responsible for setting and
6determining policy for the Agency. The Agency shall consist of:
7(1) an Abraham Lincoln Presidential Library and Museum and (2)
8a Historic Sites and Preservation Division. Except as otherwise
9provided in this Act, any reference in any other Act to the
10Historic Preservation Agency shall be deemed to be a reference
11to the Historic Sites and Preservation Division and any
12reference to the Director of Historic Preservation shall be
13deemed to be a reference to the Director of Historic Sites and
14Preservation, unless the context clearly indicates otherwise.
15    The Board shall appoint a chief executive officer of the
16Agency who shall be known as the Director of the Historic Sites
17and Preservation Agency. The Director shall serve at the
18pleasure of the Board. The Director shall, subject to
19applicable provisions of law, execute the powers and discharge
20the duties vested in the Historic Sites and Preservation
21Division of the Agency by law and implement the policies set by
22the Board. The Director shall manage the Historic Sites and
23Preservation Division of the Agency. The Director, with the
24concurrence of the Board, shall appoint Division Chiefs, if
25needed, and the Deputy Director of the Historic Sites and

1Preservation Division of the Agency. Subject to concurrence by
2the Board, the Director shall appoint such other employees of
3the Historic Sites and Preservation Division of the Agency as
4he or she deems appropriate and shall fix the compensation of
5such Division Chiefs, if any, the Deputy Director, and other
6employees. The Board shall appoint the Illinois State
7Historian, who shall provide historical expertise, support,
8and service to all divisions of the Historic Preservation
9Agency and to all divisions of the Agency, if any. The State
10Historian is the State's authority on Abraham Lincoln and the
11history of Illinois.

1the Agency shall have the following additional powers:
2    (a) To hire agents and employees necessary to carry out the
3duties and purposes of the Historic Sites and Preservation
4Division of the Agency.
5    (b) To take all measures necessary to erect, maintain,
6preserve, restore, and conserve all State Historic Sites and
7State Memorials, except when supervision and maintenance is
8otherwise provided by law. This authorization includes the
9power, with the consent of the Board, to enter into contracts,
10acquire and dispose of real and personal property, and enter
11into leases of real and personal property. The Agency has the
12power to acquire, for purposes authorized by law, any real
13property in fee simple subject to a life estate in the seller
14in not more than 3 acres of the real property acquired, subject
15to the restrictions that the life estate shall be used for
16residential purposes only and that it shall be
17non-transferable.
18    (c) To provide recreational facilities including camp
19sites, lodges and cabins, trails, picnic areas and related
20recreational facilities at all sites under the jurisdiction of
21the Agency.
22    (d) To lay out, construct and maintain all needful roads,
23parking areas, paths or trails, bridges, camp or lodge sites,
24picnic areas, lodges and cabins, and any other structures and
25improvements necessary and appropriate in any State historic
26site or easement thereto; and to provide water supplies, heat

1and light, and sanitary facilities for the public and living
2quarters for the custodians and keepers of State historic
3sites.
4    (e) To grant licenses and rights-of-way within the areas
5controlled by the Historic Sites and Preservation Division of
6the Agency for the construction, operation and maintenance
7upon, under or across the property, of facilities for water,
8sewage, telephone, telegraph, electric, gas, or other public
9service, subject to the terms and conditions as may be
10determined by the Agency.
11    (f) To authorize the officers, employees and agents of the
12Historic Sites and Preservation Division of the Agency, for the
13purposes of investigation and to exercise the rights, powers,
14and duties vested and that may be vested in it, to enter and
15cross all lands and waters in this State, doing no damage to
16private property.
17    (g) To transfer jurisdiction of or exchange any realty
18under the control of the Historic Sites and Preservation
19Division of the Agency to any other Department of the State
20Government, or to any agency of the Federal Government, or to
21acquire or accept Federal lands, when any transfer, exchange,
22acquisition or acceptance is advantageous to the State and is
23approved in writing by the Governor.
24    (h) To erect, supervise, and maintain all public monuments
25and memorials erected by the State, except when the supervision
26and maintenance of public monuments and memorials is otherwise

1provided by law.
2    (i) To accept, hold, maintain, and administer, as trustee,
3property given in trust for educational or historic purposes
4for the benefit of the People of the State of Illinois and to
5dispose, with the consent of the Board, of any property under
6the terms of the instrument creating the trust.
7    (j) To lease concessions on any property under the
8jurisdiction of the Agency for a period not exceeding 25 years
9and to lease a concession complex at Lincoln's New Salem State
10Historic Site for which a cash incentive has been authorized
11under Section 5.1 of the Historic Preservation Agency Act for a
12period not to exceed 40 years. All leases, for whatever period,
13shall be made subject to the written approval of the Governor.
14All concession leases extending for a period in excess of 10
15years, will contain provisions for the Agency to participate,
16on a percentage basis, in the revenues generated by any
17concession operation.
18    The Agency is authorized to allow for provisions for a
19reserve account and a leasehold account within Agency
20concession lease agreements for the purpose of setting aside
21revenues for the maintenance, rehabilitation, repair,
22improvement, and replacement of the concession facility,
23structure, and equipment of the Agency that are part of the
24leased premises.
25    The lessee shall be required to pay into the reserve
26account a percentage of gross receipts, as set forth in the

1lease, to be set aside and expended in a manner acceptable to
2the Agency by the concession lessee for the purpose of ensuring
3that an appropriate amount of the lessee's moneys are provided
4by the lessee to satisfy the lessee's incurred responsibilities
5for the operation of the concession facility under the terms
6and conditions of the concession lease.
7    The lessee account shall allow for the amortization of
8certain authorized expenses that are incurred by the concession
9lessee but that are not an obligation of the lessee under the
10terms and conditions of the lease agreement. The Agency may
11allow a reduction of up to 50% of the monthly rent due for the
12purpose of enabling the recoupment of the lessee's authorized
13expenditures during the term of the lease.
14    (k) To sell surplus agricultural products grown on land
15owned by or under the jurisdiction of the Historic Sites and
16Preservation Division of the Agency, when the products cannot
17be used by the Agency.
18    (l) To enforce the laws of the State and the rules and
19regulations of the Agency in or on any lands owned, leased, or
20managed by the Historic Sites and Preservation Division of the
21Agency.
22    (m) To cooperate with private organizations and agencies of
23the State of Illinois by providing areas and the use of staff
24personnel where feasible for the sale of publications on the
25historic and cultural heritage of the State and craft items
26made by Illinois craftsmen. These sales shall not conflict with

1existing concession agreements. The Historic Sites and
2Preservation Division of the Agency is authorized to negotiate
3with the organizations and agencies for a portion of the monies
4received from sales to be returned to the Historic Sites and
5Preservation Division of the Agency's Historic Sites Fund for
6the furtherance of interpretive and restoration programs.
7    (n) To establish local bank or savings and loan association
8accounts, upon the written authorization of the Director, to
9temporarily hold income received at any of its properties. The
10local accounts established under this Section shall be in the
11name of the Historic Preservation Agency and shall be subject
12to regular audits. The balance in a local bank or savings and
13loan association account shall be forwarded to the Agency for
14deposit with the State Treasurer on Monday of each week if the
15amount to be deposited in a fund exceeds $500.
16    No bank or savings and loan association shall receive
17public funds as permitted by this Section, unless it has
18complied with the requirements established under Section 6 of
19the Public Funds Investment Act.
20    (o) To accept, with the consent of the Board, offers of
21gifts, gratuities, or grants from the federal government, its
22agencies, or offices, or from any person, firm, or corporation.
23    (p) To make reasonable rules and regulations as may be
24necessary to discharge the duties of the Agency.
25    (q) With appropriate cultural organizations, to further
26and advance the goals of the Agency.

1    (r) To make grants for the purposes of planning, survey,
2rehabilitation, restoration, reconstruction, landscaping, and
3acquisition of Illinois properties (i) designated individually
4in the National Register of Historic Places, (ii) designated as
5a landmark under a county or municipal landmark ordinance, or
6(iii) located within a National Register of Historic Places
7historic district or a locally designated historic district
8when the Director determines that the property is of historic
9significance whenever an appropriation is made therefor by the
10General Assembly or whenever gifts or grants are received for
11that purpose and to promulgate regulations as may be necessary
12or desirable to carry out the purposes of the grants.
13    Grantees may, as prescribed by rule, be required to provide
14matching funds for each grant. Grants made under this
15subsection shall be known as Illinois Heritage Grants.
16    Every owner of a historic property, or the owner's agent,
17is eligible to apply for a grant under this subsection.
18    (s) To establish and implement a pilot program for charging
19admission to State historic sites. Fees may be charged for
20special events, admissions, and parking or any combination;
21fees may be charged at all sites or selected sites. All fees
22shall be deposited into the Illinois Historic Sites Fund. The
23Historic Sites and Preservation Division of the Agency shall
24have the discretion to set and adjust reasonable fees at the
25various sites, taking into consideration various factors
26including but not limited to: cost of services furnished to

1each visitor, impact of fees on attendance and tourism and the
2costs expended collecting the fees. The Agency shall keep
3careful records of the income and expenses resulting from the
4imposition of fees, shall keep records as to the attendance at
5each historic site, and shall report to the Governor and
6General Assembly by January 31 after the close of each year.
7The report shall include information on costs, expenses,
8attendance, comments by visitors, and any other information the
9Agency may believe pertinent, including:
10        (1) Recommendations as to whether fees should be
11    continued at each State historic site.
12        (2) How the fees should be structured and imposed.
13        (3) Estimates of revenues and expenses associated with
14    each site.
15    (t) To provide for overnight tent and trailer campsites and
16to provide suitable housing facilities for student and juvenile
17overnight camping groups. The Historic Sites and Preservation
18Division of the Agency shall charge rates similar to those
19charged by the Department of Conservation for the same or
20similar facilities and services.
21    (u) To engage in marketing activities designed to promote
22the sites and programs administered by the Agency. In
23undertaking these activities, the Agency may take all necessary
24steps with respect to products and services, including but not
25limited to retail sales, wholesale sales, direct marketing,
26mail order sales, telephone sales, advertising and promotion,

1purchase of product and materials inventory, design, printing
2and manufacturing of new products, reproductions, and
3adaptations, copyright and trademark licensing and royalty
4agreements, and payment of applicable taxes. In addition, the
5Agency shall have the authority to sell advertising in its
6publications and printed materials. All income from marketing
7activities shall be deposited into the Illinois Historic Sites
8Fund.

11    Sec. 22. Amistad Commission.
12    (a) Purpose. The General Assembly finds and declares that
13all people should know of and remember the human carnage and
14dehumanizing atrocities committed during the period of the
15African slave trade and slavery in America and of the vestiges
16of slavery in this country; and it is in fact vital to educate
17our citizens on these events, the legacy of slavery, the sad
18history of racism in this country, and the principles of human
19rights and dignity in a civilized society.
20    It is the policy of the State of Illinois that the history
21of the African slave trade, slavery in America, the depth of
22their impact in our society, and the triumphs of
23African-Americans and their significant contributions to the
24development of this country is the proper concern of all
25people, particularly students enrolled in the schools of the

1State of Illinois.
2    It is therefore desirable to create a Commission that, as
3an organized body and on a continuous basis, will survey,
4design, encourage, and promote the implementation of education
5and awareness programs in Illinois that are concerned with the
6African slave trade, slavery in America, the vestiges of
7slavery in this country, and the contributions of
8African-Americans in building our country; to develop
9workshops, institutes, seminars, and other teacher training
10activities designed to educate teachers on this subject matter;
11and that will be responsible for the coordination of events on
12a regular basis, throughout the State, that provide appropriate
13memorialization of the events concerning the enslavement of
14Africans and their descendants in America and their struggle
15for freedom, liberty, and equality.
16    (b) Amistad Commission. The Amistad Commission is created
17within the Agency. The Commission is named to honor the group
18of enslaved Africans transported in 1839 on a vessel named the
19Amistad who overthrew their captors and created an
20international incident that was eventually argued before the
21Supreme Court and that shed a growing light on the evils of the
22slave trade and galvanized a growing abolitionist movement
23towards demanding the end of slavery in the United States.
24    (c) Membership. The Commission shall consist of 15 members,
25including 3 ex officio members: the State Superintendent of
26Education or his or her designee, the Director of Commerce and

1Economic Opportunity or his or her designee, and the Director
2of the Historic Sites and Preservation Agency or his or her
3designee; and 12 public members. Public members shall be
4appointed as follows:
5        (i) 2 members appointed by the President of the Senate
6    and one member appointed by the Minority Leader of the
7    Senate;
8        (ii) 2 members appointed by the Speaker of the House of
9    Representatives and one member appointed by the Minority
10    Leader of the House of Representatives; and
11        (iii) 6 members, no more than 4 of whom shall be of the
12    same political party, appointed by the Governor.
13    The public members shall be residents of this State, chosen
14with due regard to broad geographic representation and ethnic
15diversity, who have served actively in organizations that
16educate the public on the history of the African slave trade,
17the contributions of African-Americans to our society, and
18civil rights issues.
19    Each public member of the Commission shall serve for a term
20of 3 years, except that of the initial members so appointed:
21one member appointed by the President of the Senate, one member
22appointed by the Speaker of the House of Representatives, and 2
23members appointed by the Governor shall serve for terms of one
24year; the member appointed by the Minority Leader of the
25Senate, one member appointed by the Speaker of the House of
26Representatives, and 2 members appointed by the Governor shall

1serve for terms of 2 years; and one member appointed by the
2President of the Senate, the member appointed by the Minority
3Leader of the House of Representatives, and 2 members appointed
4by the Governor shall serve for terms of 3 years. Public
5members shall be eligible for reappointment. They shall serve
6until their successors are appointed and qualified, and the
7term of the successor of any incumbent shall be calculated from
8the expiration of the term of that incumbent. A vacancy
9occurring other than by expiration of term shall be filled in
10the same manner as the original appointment, but for the
11unexpired term only.
12    (d) Election of chairperson; meetings. At its first meeting
13and annually thereafter, the Commission shall elect from among
14its members a chairperson and other officers it considers
15necessary or appropriate. After its first meeting, the
16Commission shall meet at least quarterly, or more frequently at
17the call of the chairperson or if requested by 9 or more
18members.
19    (e) Quorum. A majority of the members of the Commission
20constitute a quorum for the transaction of business at a
21meeting of the Commission. A majority of the members present
22and serving is required for official action of the Commission.
23    (f) Public meeting. All business that the Commission is
24authorized to perform shall be conducted at a public meeting of
25the Commission, held in compliance with the Open Meetings Act.
26    (g) Freedom of Information. A writing prepared, owned,

1used, in the possession of, or retained by the Commission in
2the performance of an official function is subject to the
3Freedom of Information Act.
4    (h) Compensation. The members of the Commission shall serve
5without compensation, but shall be entitled to reimbursement
6for all necessary expenses incurred in the performance of their
7official duties as members of the Commission from funds
8appropriated for that purpose. Reimbursement for travel,
9meals, and lodging shall be in accordance with the rules of the
10Governor's Travel Control Board.
11    (i) Duties. The Commission shall have the following
12responsibilities and duties:
13        (1) To provide, based upon the collective interest of
14    the members and the knowledge and experience of the
15    members, assistance and advice to schools within the State
16    with respect to the implementation of education, awareness
17    programs, textbooks, and educational materials concerned
18    with the African slave trade, slavery in America, the
19    vestiges of slavery in this country, and the contributions
20    of African-Americans to our society.
21        (2) To survey and catalog the extent and breadth of
22    education concerning the African slave trade, slavery in
23    America, the vestiges of slavery in this country, and the
24    contributions of African-Americans to our society
25    presently being incorporated into the curricula and
26    textbooks and taught in the school systems of the State; to

1    inventory those African slave trade, American slavery, or
2    relevant African-American history memorials, exhibits, and
3    resources that should be incorporated into courses of study
4    at educational institutions, schools, and various other
5    locations throughout the State; and to assist the State
6    Board of Education and other State and educational agencies
7    in the development and implementation of African slave
8    trade, American slavery, and African-American history
9    education programs.
10        (3) To act as a liaison with textbook publishers,
11    schools, public, private, and nonprofit resource
12    organizations, and members of the United States Senate and
13    House of Representatives and the Illinois Senate and House
14    of Representatives in order to facilitate the inclusion of
15    the history of African slavery and of African-Americans in
16    this country in the curricula of public and nonpublic
17    schools.
18        (4) To compile a roster of individual volunteers who
19    are willing to share their knowledge and experience in
20    classrooms, seminars, and workshops with students and
21    teachers on the subject of the African slave trade,
22    American slavery, the impact of slavery on our society
23    today, and the contributions of African-Americans to our
24    country.
25        (5) To coordinate events memorializing the African
26    slave trade, American slavery, and the history of

1    African-Americans in this country that reflect the
2    contributions of African-Americans in overcoming the
3    burdens of slavery and its vestiges, and to seek volunteers
4    who are willing and able to participate in commemorative
5    events that will enhance student awareness of the
6    significance of the African slave trade, American slavery,
7    its historical impact, and the struggle for freedom.
8        (6) To prepare reports for the Governor and the General
9    Assembly regarding its findings and recommendations on
10    facilitating the inclusion of the African slave trade,
11    American slavery studies, African-American history, and
12    special programs in the educational system of the State.
13        (7) To develop, in consultation with the State Board of
14    Education, curriculum guidelines that will be made
15    available to every school board for the teaching of
16    information on the African slave trade, slavery in America,
17    the vestiges of slavery in this country, and the
18    contributions of African-Americans to our country.
19        (8) To solicit, receive, and accept appropriations,
20    gifts, and donations for Commission operations and
21    programs authorized under this Section.
22    (j) Commission requests for assistance. The Commission is
23authorized to call upon any department, office, division, or
24agency of the State, or of any county, municipality, or school
25district of the State, to supply such data, program reports,
26and other information, appropriate school personnel, and

1assistance as it deems necessary to discharge its
2responsibilities under this Act. These departments, offices,
3divisions, and agencies shall, to the extent possible and not
4inconsistent with any other law of this State, cooperate with
5the Commission and shall furnish it with such information,
6appropriate school personnel, and assistance as may be
7necessary or helpful to accomplish the purposes of this Act.
8    (k) State Board of Education assistance. The State Board of
9Education shall:
10        (1) Assist the Amistad Commission in marketing and
11    distributing to educators, administrators, and school
12    districts in the State educational information and other
13    materials on the African slave trade, slavery in America,
14    the vestiges of slavery in this country, and the
15    contributions of African-Americans to our society.
16        (2) Conduct at least one teacher workshop annually on
17    the African slave trade, slavery in America, the vestiges
18    of slavery in this country, and the contributions of
19    African-Americans to our society.
20        (3) Assist the Amistad Commission in monitoring the
21    inclusion of slavery materials and curricula in the State's
22    educational system.
23        (4) Consult with the Amistad Commission to determine
24    ways it may survey, catalog, and extend slave trade and
25    American slavery education presently being taught in the
26    State's educational system.

1    The State Board of Education may, subject to the
2availability of appropriations, hire additional staff and
3consultants to carry out the duties and responsibilities
4provided within this subsection (k).
5    (l) Report. The Commission shall report its activities and
6findings, as required under subsection (i), to the Governor and
7General Assembly on or before June 30, 2006, and biannually
8thereafter.

10    (20 ILCS 3405/34)
11    Sec. 34. Internal Auditor. There is created the Office of
12the Internal Auditor of the Historic Preservation Agency. The
13Internal Auditor shall be appointed by the Board, shall serve
14at the pleasure of the Board, and shall report to the Board.
15The Internal Auditor shall audit and maintain the financial
16books, records, papers, and transactions of the Lincoln
17Presidential Library and the Historic Sites and Preservation
18Division of the Historic Preservation Agency. The Internal
19Auditor shall prepare an annual report for each fiscal year of
20the operations of the Historic Preservation Agency, which shall
21be submitted to the Board, the General Assembly, and the
22Governor. Nothing in this Section shall abridge the authority
23of the Illinois Auditor General to independently audit the
24Illinois Historic Preservation Agency or any of the libraries,
25divisions, or offices contained within the Agency.

2    Section 55. The State Historical Library Act is amended by
3changing Section 5.1 as follows:
 
4    (20 ILCS 3425/5.1)  (from Ch. 128, par. 16.1)
5    Sec. 5.1. The State Historian shall establish and supervise
6a program within the Abraham Lincoln Presidential Library
7designed to preserve as historical records selected past
8editions of newspapers of this State. Such editions shall be
9microphotographed. The negatives of such microphotographs
10shall be stored in a place provided by the Abraham Lincoln
11Presidential Library.
12    The State Historian shall determine on the basis of
13historical value the various newspaper edition files which
14shall be microphotographed and shall arrange a schedule for
15such microphotographing. The State Historian shall supervise
16the making of arrangements for acquiring access to past edition
17files with the editors or publishers of the various newspapers.
18    The method of microphotography to be employed in this
19program shall conform to the standards established pursuant to
20Section 17 of "The State Records Act", approved July 6, 1957.
21    Upon payment to the Abraham Lincoln Presidential Library of
22the required fee, any person or organization shall be supplied
23with any prints requested to be made from the negatives of the
24microphotographs. The fee required shall be determined by the

1State Historian and shall be equal in amount to the cost
2incurred by the Lincoln Presidential Library in supplying the
3requested prints.

5    Section 60. The Liquor Control Act of 1934 is amended by
6changing Section 6-15 as follows:
 
7    (235 ILCS 5/6-15)  (from Ch. 43, par. 130)
8    Sec. 6-15. No alcoholic liquors shall be sold or delivered
9in any building belonging to or under the control of the State
10or any political subdivision thereof except as provided in this
11Act. The corporate authorities of any city, village,
12incorporated town, township, or county may provide by
13ordinance, however, that alcoholic liquor may be sold or
14delivered in any specifically designated building belonging to
15or under the control of the municipality, township, or county,
16or in any building located on land under the control of the
17municipality, township, or county; provided that such township
18or county complies with all applicable local ordinances in any
19incorporated area of the township or county. Alcoholic liquor
20may be delivered to and sold under the authority of a special
21use permit on any property owned by a conservation district
22organized under the Conservation District Act, provided that
23(i) the alcoholic liquor is sold only at an event authorized by
24the governing board of the conservation district, (ii) the

1issuance of the special use permit is authorized by the local
2liquor control commissioner of the territory in which the
3property is located, and (iii) the special use permit
4authorizes the sale of alcoholic liquor for one day or less.

6belonging to or under the control of a municipality of more
7than 25,000 inhabitants, or in any building or on any golf
8course owned by a park district organized under the Park
9District Code, subject to the approval of the governing board
10of the district, or in any building or on any golf course owned
11by a forest preserve district organized under the Downstate
12Forest Preserve District Act, subject to the approval of the
13governing board of the district, or on the grounds within 500
14feet of any building owned by a forest preserve district
15organized under the Downstate Forest Preserve District Act
16during times when food is dispensed for consumption within 500
17feet of the building from which the food is dispensed, subject
18to the approval of the governing board of the district, or in a
19building owned by a Local Mass Transit District organized under
20the Local Mass Transit District Act, subject to the approval of
21the governing Board of the District, or in Bicentennial Park,
22or on the premises of the City of Mendota Lake Park located
23adjacent to Route 51 in Mendota, Illinois, or on the premises
24of Camden Park in Milan, Illinois, or in the community center
25owned by the City of Loves Park that is located at 1000 River
26Park Drive in Loves Park, Illinois, or, in connection with the

6Science and Industry, DuSable Museum of African American
7History, John G. Shedd Aquarium and Adler Planetarium, or at
8Lakeview Museum of Arts and Sciences in Peoria, or in
9connection with the operation of the facilities of the Chicago
10Zoological Society or the Chicago Horticultural Society on land
11owned by the Forest Preserve District of Cook County, or on any
12land used for a golf course or for recreational purposes owned
13by the Forest Preserve District of Cook County, subject to the
14control of the Forest Preserve District Board of Commissioners
15and applicable local law, provided that dram shop liability
16insurance is provided at maximum coverage limits so as to hold
17the District harmless from all financial loss, damage, and
18harm, or in any building located on land owned by the Chicago
19Park District if approved by the Park District Commissioners,
20or on any land used for a golf course or for recreational
21purposes and owned by the Illinois International Port District
22if approved by the District's governing board, or at any
23airport, golf course, faculty center, or facility in which
24conference and convention type activities take place belonging
25to or under control of any State university or public community
26college district, provided that with respect to a facility for

8university or a public community college district are active
9participants in the conference or convention, or in Memorial
10Stadium on the campus of the University of Illinois at
11Urbana-Champaign during games in which the Chicago Bears
12professional football team is playing in that stadium during
13the renovation of Soldier Field, not more than one and a half
14hours before the start of the game and not after the end of the
15third quarter of the game, or in the Pavilion Facility on the
16campus of the University of Illinois at Chicago during games in
17which the Chicago Storm professional soccer team is playing in
18that facility, not more than one and a half hours before the
19start of the game and not after the end of the third quarter of
20the game, or in the Pavilion Facility on the campus of the
21University of Illinois at Chicago during games in which the
22WNBA professional women's basketball team is playing in that
23facility, not more than one and a half hours before the start
24of the game and not after the 10-minute mark of the second half
25of the game, or by a catering establishment which has rented
26facilities from a board of trustees of a public community

1college district, or in a restaurant that is operated by a
2commercial tenant in the North Campus Parking Deck building
3that (1) is located at 1201 West University Avenue, Urbana,
4Illinois and (2) is owned by the Board of Trustees of the
5University of Illinois, or, if approved by the District board,
6on land owned by the Metropolitan Sanitary District of Greater
7Chicago and leased to others for a term of at least 20 years.
8Nothing in this Section precludes the sale or delivery of
9alcoholic liquor in the form of original packaged goods in
10premises located at 500 S. Racine in Chicago belonging to the
11University of Illinois and used primarily as a grocery store by
12a commercial tenant during the term of a lease that predates
13the University's acquisition of the premises; but the
14University shall have no power or authority to renew, transfer,
15or extend the lease with terms allowing the sale of alcoholic
16liquor; and the sale of alcoholic liquor shall be subject to
17all local laws and regulations. After the acquisition by
18Winnebago County of the property located at 404 Elm Street in
19Rockford, a commercial tenant who sold alcoholic liquor at
20retail on a portion of the property under a valid license at
21the time of the acquisition may continue to do so for so long
22as the tenant and the County may agree under existing or future
23leases, subject to all local laws and regulations regarding the
24sale of alcoholic liquor. Alcoholic liquors may be delivered to
25and sold at Memorial Hall, located at 211 North Main Street,
26Rockford, under conditions approved by Winnebago County and

1subject to all local laws and regulations regarding the sale of
2alcoholic liquor. Each facility shall provide dram shop
3liability in maximum insurance coverage limits so as to save
4harmless the State, municipality, State university, airport,
5golf course, faculty center, facility in which conference and
6convention type activities take place, park district, Forest
7Preserve District, public community college district,
8aquarium, museum, or sanitary district from all financial loss,
9damage or harm. Alcoholic liquors may be sold at retail in
10buildings of golf courses owned by municipalities or Illinois
11State University in connection with the operation of an
12established food serving facility during times when food is
13dispensed for consumption upon the premises. Alcoholic liquors
14may be delivered to and sold at retail in any building owned by
15a fire protection district organized under the Fire Protection
16District Act, provided that such delivery and sale is approved
17by the board of trustees of the district, and provided further
18that such delivery and sale is limited to fundraising events
19and to a maximum of 6 events per year. However, the limitation
20to fundraising events and to a maximum of 6 events per year
21does not apply to the delivery, sale, or manufacture of
22alcoholic liquors at the building located at 59 Main Street in
23Oswego, Illinois, owned by the Oswego Fire Protection District
24if the alcoholic liquor is sold or dispensed as approved by the
25Oswego Fire Protection District and the property is no longer
26being utilized for fire protection purposes.

1    Alcoholic liquors may be served or sold in buildings under
2the control of the Board of Trustees of the University of
3Illinois for events that the Board may determine are public
4events and not related student activities. The Board of
5Trustees shall issue a written policy within 6 months of the
6effective date of this amendatory Act of the 95th General
7Assembly concerning the types of events that would be eligible
8for an exemption. Thereafter, the Board of Trustees may issue
9revised, updated, new, or amended policies as it deems
10necessary and appropriate. In preparing its written policy, the
11Board of Trustees shall, among other factors it considers
12relevant and important, give consideration to the following:
13(i) whether the event is a student activity or student related
14activity; (ii) whether the physical setting of the event is
15conducive to control of liquor sales and distribution; (iii)
16the ability of the event operator to ensure that the sale or
17serving of alcoholic liquors and the demeanor of the
18participants are in accordance with State law and University
19policies; (iv) regarding the anticipated attendees at the
20event, the relative proportion of individuals under the age of
2121 to individuals age 21 or older; (v) the ability of the venue
22operator to prevent the sale or distribution of alcoholic
23liquors to individuals under the age of 21; (vi) whether the
24event prohibits participants from removing alcoholic beverages
25from the venue; and (vii) whether the event prohibits
26participants from providing their own alcoholic liquors to the

1venue. In addition, any policy submitted by the Board of
2Trustees to the Illinois Liquor Control Commission must require
3that any event at which alcoholic liquors are served or sold in
4buildings under the control of the Board of Trustees shall
5require the prior written approval of the Office of the
6Chancellor for the University campus where the event is
7located. The Board of Trustees shall submit its policy, and any
8subsequently revised, updated, new, or amended policies, to the
9Illinois Liquor Control Commission, and any University event,
10or location for an event, exempted under such policies shall
11apply for a license under the applicable Sections of this Act.
12    Alcoholic liquors may be served or sold in buildings under
13the control of the Board of Trustees of Northern Illinois
14University for events that the Board may determine are public
15events and not student-related activities. The Board of
16Trustees shall issue a written policy within 6 months after
17June 28, 2011 (the effective date of Public Act 97-45)
18concerning the types of events that would be eligible for an
19exemption. Thereafter, the Board of Trustees may issue revised,
20updated, new, or amended policies as it deems necessary and
21appropriate. In preparing its written policy, the Board of
22Trustees shall, in addition to other factors it considers
23relevant and important, give consideration to the following:
24(i) whether the event is a student activity or student-related
25activity; (ii) whether the physical setting of the event is
26conducive to control of liquor sales and distribution; (iii)

1the ability of the event operator to ensure that the sale or
2serving of alcoholic liquors and the demeanor of the
3participants are in accordance with State law and University
4policies; (iv) the anticipated attendees at the event and the
5relative proportion of individuals under the age of 21 to
6individuals age 21 or older; (v) the ability of the venue
7operator to prevent the sale or distribution of alcoholic
8liquors to individuals under the age of 21; (vi) whether the
9event prohibits participants from removing alcoholic beverages
10from the venue; and (vii) whether the event prohibits
11participants from providing their own alcoholic liquors to the
12venue.
13    Alcoholic liquors may be served or sold in buildings under
14the control of the Board of Trustees of Chicago State
15University for events that the Board may determine are public
16events and not student-related activities. The Board of
17Trustees shall issue a written policy within 6 months after
18August 2, 2013 (the effective date of Public Act 98-132) this
19amendatory Act of the 98th General Assembly concerning the
20types of events that would be eligible for an exemption.
21Thereafter, the Board of Trustees may issue revised, updated,
22new, or amended policies as it deems necessary and appropriate.
23In preparing its written policy, the Board of Trustees shall,
24in addition to other factors it considers relevant and
25important, give consideration to the following: (i) whether the
26event is a student activity or student-related activity; (ii)

1whether the physical setting of the event is conducive to
2control of liquor sales and distribution; (iii) the ability of
3the event operator to ensure that the sale or serving of
4alcoholic liquors and the demeanor of the participants are in
5accordance with State law and University policies; (iv) the
6anticipated attendees at the event and the relative proportion
7of individuals under the age of 21 to individuals age 21 or
8older; (v) the ability of the venue operator to prevent the
9sale or distribution of alcoholic liquors to individuals under
10the age of 21; (vi) whether the event prohibits participants
11from removing alcoholic beverages from the venue; and (vii)
12whether the event prohibits participants from providing their
13own alcoholic liquors to the venue.
14    Alcoholic liquors may be served or sold in buildings under
15the control of the Board of Trustees of Illinois State
16University for events that the Board may determine are public
17events and not student-related activities. The Board of
18Trustees shall issue a written policy within 6 months after the
19effective date of this amendatory Act of the 97th General
20Assembly concerning the types of events that would be eligible
21for an exemption. Thereafter, the Board of Trustees may issue
22revised, updated, new, or amended policies as it deems
23necessary and appropriate. In preparing its written policy, the
24Board of Trustees shall, in addition to other factors it
25considers relevant and important, give consideration to the
26following: (i) whether the event is a student activity or

1student-related activity; (ii) whether the physical setting of
2the event is conducive to control of liquor sales and
3distribution; (iii) the ability of the event operator to ensure
4that the sale or serving of alcoholic liquors and the demeanor
5of the participants are in accordance with State law and
6University policies; (iv) the anticipated attendees at the
7event and the relative proportion of individuals under the age
8of 21 to individuals age 21 or older; (v) the ability of the
9venue operator to prevent the sale or distribution of alcoholic
10liquors to individuals under the age of 21; (vi) whether the
11event prohibits participants from removing alcoholic beverages
12from the venue; and (vii) whether the event prohibits
13participants from providing their own alcoholic liquors to the
14venue.
15    Alcoholic liquor may be delivered to and sold at retail in
16the Dorchester Senior Business Center owned by the Village of
17Dolton if the alcoholic liquor is sold or dispensed only in
18connection with organized functions for which the planned
19attendance is 20 or more persons, and if the person or facility
20selling or dispensing the alcoholic liquor has provided dram
21shop liability insurance in maximum limits so as to hold
22harmless the Village of Dolton and the State from all financial
23loss, damage and harm.
24    Alcoholic liquors may be delivered to and sold at retail in
25any building used as an Illinois State Armory provided:
26        (i) the Adjutant General's written consent to the

1    issuance of a license to sell alcoholic liquor in such
2    building is filed with the Commission;
3        (ii) the alcoholic liquor is sold or dispensed only in
4    connection with organized functions held on special
5    occasions;
6        (iii) the organized function is one for which the
7    planned attendance is 25 or more persons; and
8        (iv) the facility selling or dispensing the alcoholic
9    liquors has provided dram shop liability insurance in
10    maximum limits so as to save harmless the facility and the
11    State from all financial loss, damage or harm.
12    Alcoholic liquors may be delivered to and sold at retail in
13the Chicago Civic Center, provided that:
14        (i) the written consent of the Public Building
15    Commission which administers the Chicago Civic Center is
16    filed with the Commission;
17        (ii) the alcoholic liquor is sold or dispensed only in
18    connection with organized functions held on special
19    occasions;
20        (iii) the organized function is one for which the
21    planned attendance is 25 or more persons;
22        (iv) the facility selling or dispensing the alcoholic
23    liquors has provided dram shop liability insurance in
24    maximum limits so as to hold harmless the Civic Center, the
25    City of Chicago and the State from all financial loss,
26    damage or harm; and

1        (v) all applicable local ordinances are complied with.
2    Alcoholic liquors may be delivered or sold in any building
3belonging to or under the control of any city, village or
4incorporated town where more than 75% of the physical
5properties of the building is used for commercial or
6recreational purposes, and the building is located upon a pier
7extending into or over the waters of a navigable lake or stream
8or on the shore of a navigable lake or stream. In accordance
9with a license issued under this Act, alcoholic liquor may be
10sold, served, or delivered in buildings and facilities under
11the control of the Department of Natural Resources during
12events or activities lasting no more than 7 continuous days
13upon the written approval of the Director of Natural Resources
14acting as the controlling government authority. The Director of
15Natural Resources may specify conditions on that approval,
16including but not limited to requirements for insurance and
17hours of operation. Notwithstanding any other provision of this
18Act, alcoholic liquor sold by a United States Army Corps of
19Engineers or Department of Natural Resources concessionaire
20who was operating on June 1, 1991 for on-premises consumption
21only is not subject to the provisions of Articles IV and IX.
22Beer and wine may be sold on the premises of the Joliet Park
23District Stadium owned by the Joliet Park District when written
24consent to the issuance of a license to sell beer and wine in
25such premises is filed with the local liquor commissioner by
26the Joliet Park District. Beer and wine may be sold in

1buildings on the grounds of State veterans' homes when written
2consent to the issuance of a license to sell beer and wine in
3such buildings is filed with the Commission by the Department
4of Veterans' Affairs, and the facility shall provide dram shop
5liability in maximum insurance coverage limits so as to save
6the facility harmless from all financial loss, damage or harm.
7Such liquors may be delivered to and sold at any property owned
8or held under lease by a Metropolitan Pier and Exposition
9Authority or Metropolitan Exposition and Auditorium Authority.
10    Beer and wine may be sold and dispensed at professional
11sporting events and at professional concerts and other
12entertainment events conducted on premises owned by the Forest
13Preserve District of Kane County, subject to the control of the
14District Commissioners and applicable local law, provided that
15dram shop liability insurance is provided at maximum coverage
16limits so as to hold the District harmless from all financial
17loss, damage and harm.
18    Nothing in this Section shall preclude the sale or delivery
19of beer and wine at a State or county fair or the sale or
20delivery of beer or wine at a city fair in any otherwise lawful
21manner.
22    Alcoholic liquors may be sold at retail in buildings in
23State parks under the control of the Department of Natural
24Resources, provided:
25        a. the State park has overnight lodging facilities with
26    some restaurant facilities or, not having overnight

1    lodging facilities, has restaurant facilities which serve
2    complete luncheon and dinner or supper meals,
3        b. consent to the issuance of a license to sell
4    alcoholic liquors in the buildings has been filed with the
5    commission by the Department of Natural Resources, and
6        c. the alcoholic liquors are sold by the State park
7    lodge or restaurant concessionaire only during the hours
8    from 11 o'clock a.m. until 12 o'clock midnight.
9    Notwithstanding any other provision of this Act, alcoholic
10    liquor sold by the State park or restaurant concessionaire
11    is not subject to the provisions of Articles IV and IX.
12    Alcoholic liquors may be sold at retail in buildings on
13properties under the control of the Historic Sites and
14Preservation Division of the Historic Preservation Agency or
15the Abraham Lincoln Presidential Library and Museum provided:
16        a. the property has overnight lodging facilities with
17    some restaurant facilities or, not having overnight
18    lodging facilities, has restaurant facilities which serve
19    complete luncheon and dinner or supper meals,
20        b. consent to the issuance of a license to sell
21    alcoholic liquors in the buildings has been filed with the
22    commission by the Historic Sites and Preservation Division
23    of the Historic Preservation Agency or the Abraham Lincoln
24    Presidential Library and Museum, and
25        c. the alcoholic liquors are sold by the lodge or
26    restaurant concessionaire only during the hours from 11

1    o'clock a.m. until 12 o'clock midnight.
2    The sale of alcoholic liquors pursuant to this Section does
3not authorize the establishment and operation of facilities
4commonly called taverns, saloons, bars, cocktail lounges, and
5the like except as a part of lodge and restaurant facilities in
6State parks or golf courses owned by Forest Preserve Districts
7with a population of less than 3,000,000 or municipalities or
8park districts.
9    Alcoholic liquors may be sold at retail in the Springfield
10Administration Building of the Department of Transportation
11and the Illinois State Armory in Springfield; provided, that
12the controlling government authority may consent to such sales
13only if
14        a. the request is from a not-for-profit organization;
15        b. such sales would not impede normal operations of the
16    departments involved;
17        c. the not-for-profit organization provides dram shop
18    liability in maximum insurance coverage limits and agrees
19    to defend, save harmless and indemnify the State of
20    Illinois from all financial loss, damage or harm;
21        d. no such sale shall be made during normal working
22    hours of the State of Illinois; and
23        e. the consent is in writing.
24    Alcoholic liquors may be sold at retail in buildings in
25recreational areas of river conservancy districts under the
26control of, or leased from, the river conservancy districts.

1Such sales are subject to reasonable local regulations as
2provided in Article IV; however, no such regulations may
3prohibit or substantially impair the sale of alcoholic liquors
4on Sundays or Holidays.
5    Alcoholic liquors may be provided in long term care
6facilities owned or operated by a county under Division 5-21 or
75-22 of the Counties Code, when approved by the facility
8operator and not in conflict with the regulations of the
9Illinois Department of Public Health, to residents of the
10facility who have had their consumption of the alcoholic
11liquors provided approved in writing by a physician licensed to
12practice medicine in all its branches.
13    Alcoholic liquors may be delivered to and dispensed in
14State housing assigned to employees of the Department of
15Corrections. No person shall furnish or allow to be furnished
16any alcoholic liquors to any prisoner confined in any jail,
17reformatory, prison or house of correction except upon a
18physician's prescription for medicinal purposes.
19    Alcoholic liquors may be sold at retail or dispensed at the
20Willard Ice Building in Springfield, at the State Library in
21Springfield, and at Illinois State Museum facilities by (1) an
22agency of the State, whether legislative, judicial or
23executive, provided that such agency first obtains written
24permission to sell or dispense alcoholic liquors from the
25controlling government authority, or by (2) a not-for-profit
26organization, provided that such organization:

1        a. Obtains written consent from the controlling
2    government authority;
3        b. Sells or dispenses the alcoholic liquors in a manner
4    that does not impair normal operations of State offices
5    located in the building;
6        c. Sells or dispenses alcoholic liquors only in
7    connection with an official activity in the building;
8        d. Provides, or its catering service provides, dram
9    shop liability insurance in maximum coverage limits and in
10    which the carrier agrees to defend, save harmless and
11    indemnify the State of Illinois from all financial loss,
12    damage or harm arising out of the selling or dispensing of
13    alcoholic liquors.
14    Nothing in this Act shall prevent a not-for-profit
15organization or agency of the State from employing the services
16of a catering establishment for the selling or dispensing of
17alcoholic liquors at authorized functions.
18    The controlling government authority for the Willard Ice
19Building in Springfield shall be the Director of the Department
20of Revenue. The controlling government authority for Illinois
21State Museum facilities shall be the Director of the Illinois
22State Museum. The controlling government authority for the
23State Library in Springfield shall be the Secretary of State.
24    Alcoholic liquors may be delivered to and sold at retail or
25dispensed at any facility, property or building under the
26jurisdiction of the Historic Sites and Preservation Division of

1the Historic Preservation Agency or the Abraham Lincoln
2Presidential Library and Museum where the delivery, sale or
3dispensing is by (1) an agency of the State, whether
4legislative, judicial or executive, provided that such agency
5first obtains written permission to sell or dispense alcoholic
6liquors from a controlling government authority, or by (2) an
7individual or organization provided that such individual or
8organization:
9        a. Obtains written consent from the controlling
10    government authority;
11        b. Sells or dispenses the alcoholic liquors in a manner
12    that does not impair normal workings of State offices or
13    operations located at the facility, property or building;
14        c. Sells or dispenses alcoholic liquors only in
15    connection with an official activity of the individual or
16    organization in the facility, property or building;
17        d. Provides, or its catering service provides, dram
18    shop liability insurance in maximum coverage limits and in
19    which the carrier agrees to defend, save harmless and
20    indemnify the State of Illinois from all financial loss,
21    damage or harm arising out of the selling or dispensing of
22    alcoholic liquors.
23    The controlling government authority for the Historic
24Sites and Preservation Division of the Historic Preservation
25Agency shall be the Director of the Historic Sites and
26Preservation Agency, and the controlling government authority

1for the Abraham Lincoln Presidential Library and Museum shall
2be the Executive Director of the Abraham Lincoln Presidential
3Library and Museum.
4    Alcoholic liquors may be delivered to and sold at retail or
5dispensed for consumption at the Michael Bilandic Building at
6160 North LaSalle Street, Chicago IL 60601, after the normal
7business hours of any day care or child care facility located
8in the building, by (1) a commercial tenant or subtenant
9conducting business on the premises under a lease made pursuant
10to Section 405-315 of the Department of Central Management
11Services Law (20 ILCS 405/405-315), provided that such tenant
12or subtenant who accepts delivery of, sells, or dispenses
13alcoholic liquors shall procure and maintain dram shop
14liability insurance in maximum coverage limits and in which the
15carrier agrees to defend, indemnify, and save harmless the
16State of Illinois from all financial loss, damage, or harm
17arising out of the delivery, sale, or dispensing of alcoholic
18liquors, or by (2) an agency of the State, whether legislative,
19judicial, or executive, provided that such agency first obtains
20written permission to accept delivery of and sell or dispense
21alcoholic liquors from the Director of Central Management
22Services, or by (3) a not-for-profit organization, provided
23that such organization:
24        a. obtains written consent from the Department of
25    Central Management Services;
26        b. accepts delivery of and sells or dispenses the

1    alcoholic liquors in a manner that does not impair normal
2    operations of State offices located in the building;
3        c. accepts delivery of and sells or dispenses alcoholic
4    liquors only in connection with an official activity in the

6        d. provides, or its catering service provides, dram
7    shop liability insurance in maximum coverage limits and in
8    which the carrier agrees to defend, save harmless, and
9    indemnify the State of Illinois from all financial loss,
10    damage, or harm arising out of the selling or dispensing of
11    alcoholic liquors.
12    Nothing in this Act shall prevent a not-for-profit
13organization or agency of the State from employing the services
14of a catering establishment for the selling or dispensing of
15alcoholic liquors at functions authorized by the Director of
16Central Management Services.
17    Alcoholic liquors may be sold at retail or dispensed at the
18James R. Thompson Center in Chicago, subject to the provisions
19of Section 7.4 of the State Property Control Act, and 222 South
20College Street in Springfield, Illinois by (1) a commercial
21tenant or subtenant conducting business on the premises under a
22lease or sublease made pursuant to Section 405-315 of the
23Department of Central Management Services Law (20 ILCS
24405/405-315), provided that such tenant or subtenant who sells
25or dispenses alcoholic liquors shall procure and maintain dram
26shop liability insurance in maximum coverage limits and in

1which the carrier agrees to defend, indemnify and save harmless
2the State of Illinois from all financial loss, damage or harm

6permission to sell or dispense alcoholic liquors from the
7Director of Central Management Services, or by (3) a
8not-for-profit organization, provided that such organization:
9        a. Obtains written consent from the Department of
10    Central Management Services;
11        b. Sells or dispenses the alcoholic liquors in a manner
12    that does not impair normal operations of State offices
13    located in the building;
14        c. Sells or dispenses alcoholic liquors only in
15    connection with an official activity in the building;
16        d. Provides, or its catering service provides, dram
17    shop liability insurance in maximum coverage limits and in
18    which the carrier agrees to defend, save harmless and
19    indemnify the State of Illinois from all financial loss,
20    damage or harm arising out of the selling or dispensing of
21    alcoholic liquors.
22    Nothing in this Act shall prevent a not-for-profit
23organization or agency of the State from employing the services
24of a catering establishment for the selling or dispensing of
25alcoholic liquors at functions authorized by the Director of
26Central Management Services.

2owned by the Illinois Sports Facilities Authority provided that
3dram shop liability insurance has been made available in a
4form, with such coverage and in such amounts as the Authority
5reasonably determines is necessary.
6    Alcoholic liquors may be sold at retail or dispensed at the
7Rockford State Office Building by (1) an agency of the State,
8whether legislative, judicial or executive, provided that such
9agency first obtains written permission to sell or dispense
10alcoholic liquors from the Department of Central Management
11Services, or by (2) a not-for-profit organization, provided
12that such organization:
13        a. Obtains written consent from the Department of
14    Central Management Services;
15        b. Sells or dispenses the alcoholic liquors in a manner
16    that does not impair normal operations of State offices
17    located in the building;
18        c. Sells or dispenses alcoholic liquors only in
19    connection with an official activity in the building;
20        d. Provides, or its catering service provides, dram
21    shop liability insurance in maximum coverage limits and in
22    which the carrier agrees to defend, save harmless and
23    indemnify the State of Illinois from all financial loss,
24    damage or harm arising out of the selling or dispensing of
25    alcoholic liquors.
26    Nothing in this Act shall prevent a not-for-profit

1organization or agency of the State from employing the services
2of a catering establishment for the selling or dispensing of
3alcoholic liquors at functions authorized by the Department of
4Central Management Services.
5    Alcoholic liquors may be sold or delivered in a building
6that is owned by McLean County, situated on land owned by the
7county in the City of Bloomington, and used by the McLean
8County Historical Society if the sale or delivery is approved
9by an ordinance adopted by the county board, and the
10municipality in which the building is located may not prohibit
11that sale or delivery, notwithstanding any other provision of
12this Section. The regulation of the sale and delivery of
13alcoholic liquor in a building that is owned by McLean County,
14situated on land owned by the county, and used by the McLean
15County Historical Society as provided in this paragraph is an
16exclusive power and function of the State and is a denial and
17limitation under Article VII, Section 6, subsection (h) of the
18Illinois Constitution of the power of a home rule municipality
19to regulate that sale and delivery.
20    Alcoholic liquors may be sold or delivered in any building
21situated on land held in trust for any school district
22organized under Article 34 of the School Code, if the building
23is not used for school purposes and if the sale or delivery is
24approved by the board of education.
25    Alcoholic liquors may be sold or delivered in buildings
26owned by the Community Building Complex Committee of Boone

1County, Illinois if the person or facility selling or
2dispensing the alcoholic liquor has provided dram shop
3liability insurance with coverage and in amounts that the
4Committee reasonably determines are necessary.
5    Alcoholic liquors may be sold or delivered in the building
6located at 1200 Centerville Avenue in Belleville, Illinois and
7occupied by either the Belleville Area Special Education
8District or the Belleville Area Special Services Cooperative.
9    Alcoholic liquors may be delivered to and sold at the Louis
10Joliet Renaissance Center, City Center Campus, located at 214
11N. Ottawa Street, Joliet, and the Food Services/Culinary Arts
12Department facilities, Main Campus, located at 1215 Houbolt
13Road, Joliet, owned by or under the control of Joliet Junior
14College, Illinois Community College District No. 525.
15    Alcoholic liquors may be delivered to and sold at Triton
16College, Illinois Community College District No. 504.
17    Alcoholic liquors may be delivered to and sold at the
18College of DuPage, Illinois Community College District No. 502.
19    Alcoholic liquors may be delivered to and sold at the
20building located at 446 East Hickory Avenue in Apple River,
21Illinois, owned by the Apple River Fire Protection District,
22and occupied by the Apple River Community Association if the
23alcoholic liquor is sold or dispensed only in connection with
24organized functions approved by the Apple River Community
25Association for which the planned attendance is 20 or more
26persons and if the person or facility selling or dispensing the

1alcoholic liquor has provided dram shop liability insurance in
2maximum limits so as to hold harmless the Apple River Fire
3Protection District, the Village of Apple River, and the Apple
4River Community Association from all financial loss, damage,

6    Alcoholic liquors may be delivered to and sold at the Sikia
7Restaurant, Kennedy King College Campus, located at 740 West
863rd Street, Chicago, and at the Food Services in the Great
9Hall/Washburne Culinary Institute Department facility, Kennedy
10King College Campus, located at 740 West 63rd Street, Chicago,
11owned by or under the control of City Colleges of Chicago,
12Illinois Community College District No. 508.
