AMENDMENT TO HOUSE BILL 3913




2    AMENDMENT NO. ______. Amend House Bill 3913 by replacing 
3everything after the enacting clause with the following:

 
 
4    "Section 5. The Illinois Municipal Code is amended  by 
5adding Section 11-80-24 as follows:
 
6    (65 ILCS 5/11-80-24 new)
7    Sec. 11-80-24. Bicycle sharing systems. No bicycle sharing 
8system may operate a docking station in any area in any 
9municipality if (1) the area is adjacent to the primary 
10entrance of any elementary or secondary school building, (2) 
11the area is within 125 feet of any  entrance to any elementary 
12or secondary school building, and (3) the area may be used as a 
13fire lane by emergency vehicles.
14    For purposes of this Section:
15    "Bicycle sharing system" means a fleet of bicycles that are 
16locked into a network of docking stations that may be rented

1from and returned to any station in the system.
2    "Docking station" includes, but is not limited to, a 
3touch-screen kiosk, station map, and a docking system that 
4releases bicycles using a member key or code.
5    "Fire lane" shall have the same meaning provided under 
6subsection (h) of Section 11-209 of the Illinois Vehicle Code. 
7    A home rule municipality may not regulate bicycle sharing 
8systems in a manner less restrictive than requirements of this 
9Section. This Section is a limitation under subsection (i) of 
10Section 6 of Article VII of the Illinois Constitution on the 
11concurrent exercise by home rule units of powers and functions 
12exercised by the State.".
