| 1 | | AN ACT concerning education.
|
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Board of Higher Education Act is amended by |
| 5 | | adding Section 8.5 as follows:
|
| 6 | | (110 ILCS 205/8.5 new) |
| 7 | | Sec. 8.5. Capital appropriation; facility renovations at |
| 8 | | universities. |
| 9 | | (a) With regard to a capital appropriation made on or after |
| 10 | | the effective date of this amendatory Act of the 98th General |
| 11 | | Assembly for new construction only, up to 10% of that |
| 12 | | appropriation may, at the request of a public university's |
| 13 | | board of trustees, be set aside in a separate fund held locally |
| 14 | | by the university for use in addressing capital renewal or |
| 15 | | deferred maintenance needs as they arise. |
| 16 | | (b) The Board shall allow public universities to |
| 17 | | recalculate project requests for prioritization if they elect |
| 18 | | to utilize the capital renewal set-aside provided for in this |
| 19 | | Section.

| 20 | | Section 99. Effective date. This Act takes effect July 1, |
| 21 | | 2014.
