| 2 | AMENDMENT NO. ______. Amend House Bill 3961 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. If and only if Senate Bill 2202 of the 98th | ||||||
| 5 | General Assembly, as amended by House Amendment No. 1, becomes | ||||||
| 6 | law, then "An Act concerning higher education" (Senate Bill | ||||||
| 7 | 2202 of the 98th General Assembly) is amended by changing | ||||||
| 8 | Section 15 as follows: | ||||||
| 9 | (S.B. 2202 98th G.A., Sec. 15)
| ||||||
| 10 | Sec. 15. Prohibitions on smoking.
| ||||||
| 11 | (a) Beginning on July 1, 2015, smoking is prohibited on | ||||||
| 12 | each campus of a State-supported institution of higher | ||||||
| 13 | education. The prohibition set forth in this subsection (a) | ||||||
| 14 | shall not apply to any instance in which an individual is | ||||||
| 15 | traveling through or parked on a campus in a vehicle that is | ||||||
| 16 | not owned by a State-supported institution of higher education. | ||||||

| 1 | (b) An individual or campus subject to the smoking | ||||||
| 2 | prohibitions of this Act may not discriminate or retaliate in | ||||||
| 3 | any manner against a person for making a complaint of a | ||||||
| 4 | violation of this Act or furnishing information concerning a | ||||||
| 5 | violation to a person, campus, or governing authority. | ||||||
| 6 | (c) The prohibitions on smoking in this Act must be | ||||||
| 7 | communicated to all students and employees of State-supported | ||||||
| 8 | institutions of higher education on or before May 1, 2015 and | ||||||
| 9 | to each guest of a State-supported institution of higher | ||||||
| 10 | education upon request. | ||||||
| 11 | (d) Each State-supported institution of higher education | ||||||
| 12 | shall create and post on its Internet website a smoke-free | ||||||
| 13 | campus map indicating the locations where smoking is prohibited | ||||||
| 14 | under this Act.

| 16 | Section 99. Effective date. This Act takes effect upon | ||||||
| 17 | becoming law or on the date Senate Bill 2202 of the 98th | ||||||
