| 10 | | Sec. 45. Continuation of current practices. |
| 11 | | Notwithstanding any other
provision of this Act, a unit of |
| 12 | | local government or emergency telephone
system board providing |
| 13 | | wireless 9-1-1 service and imposing and collecting a
wireless |
| 14 | | carrier surcharge prior to July 1, 1998 may continue its |
| 15 | | practices of
imposing and collecting its wireless carrier |

| 1 | | surcharge, but in no event shall
that monthly surcharge exceed |
| 2 | | $2.50
per commercial mobile radio service (CMRS)
connection or |
| 3 | | in-service telephone number billed on a monthly basis.
For |
| 4 | | mobile telecommunications services provided on and after |
| 5 | | August 1, 2002,
any surcharge imposed shall be imposed based |
| 6 | | upon the municipality or county
that encompasses the customer's |
| 7 | | place of primary use as defined in the Mobile
|
| 8 | | Telecommunications Sourcing Conformity Act.
|
| 9 | | In addition to any other lawful purpose, a municipality |
| 10 | | with a population over 500,000 may use the moneys collected |
| 11 | | under this Section for any anti-terrorism or emergency |
| 12 | | preparedness measures, including, but not limited to, |
| 13 | | preparedness planning, providing local matching funds for |
| 14 | | federal or State grants, personnel training, and specialized |
| 15 | | equipment, including surveillance cameras as needed to deal |
| 16 | | with natural and terrorist-inspired emergency situations or |
| 17 | | events.
|
| 18 | | For surcharges collected and remitted pursuant to this |
| 19 | | Section from July 1, 2014 through June 30, 2016, $0.015 per |
| 20 | | surcharge collected shall be deposited into the Poison Response |
| 21 | | Fund for distribution monthly to a human poison control center |
| 22 | | as defined in Section 10 of the Poison Control System Act. |
| 23 | | For surcharges collected and remitted pursuant to this |
| 24 | | Section from July 1, 2016 through June 30, 2018, $0.0175 per |
| 25 | | surcharge collected shall be deposited into the Poison Response |
| 26 | | Fund for distribution monthly to a human poison control center |

| 1 | | as defined in Section 10 of the Poison Control System Act. |
| 2 | | For surcharges collected and remitted pursuant to this |

| 5 | | distribution monthly to a human poison control center as |
| 6 | | defined in Section 10 of the Poison Control System Act. |
